Question for anyone in USA who did a non O-A visa. For the background check, did you use the FBI or a state agency? I live in Montana and obtained a criminal history from a state law enforcement agency. Just wondering if anyone used a state agency for theirs and if it met the requirements. Thanks for any info

TLDR : Answer Summary
The discussion centers around the requirements for obtaining a Non O-A visa, specifically regarding background checks. There is some confusion about whether to use an FBI background check or if a state agency suffices. Several commenters share their experiences, emphasizing that while the RTE website indicates that a state agency can be used, it is recommended to get the check from your state's Bureau of Investigation (SBI). Fingerprinting may be required depending on the agency. Additionally, some commenters mention the current unavailability of Non O-A visas and share insights on income considerations for spouses applying together.

It asks for it on the application process and if you don't submit it they will not approve your application

I forget what the state agency was. Fingerprinting was not an option with them. It does clearly say on the RTE website that it can be through a state agency or FBI

From experience in the last 2 weeks you have to get it from your state Bureau of Investigation and you have to be fingerprinted

I mean, they're the ones that are issuing you the visa so if they'll accept the state level background check then that's fine.

Pretty sure it has to be at the federal level. Use an FBI authorized company (they have a list on their website), can get it in a couple days.
