Hello all… maybe you can answer this for me! Apparently I need a background check to show when I file for my non o visa. To what degree does the background check need to be? Just a background check or do fingerprints need to accompany the background check?
Answer summary
The discussion revolves around whether a background check is needed when applying for a Non-O visa in Thailand. While some commenters assert that a background check and fingerprints are necessary for a Non-O A visa, others clarify that these are not required for the standard 90-day Non-O visa. Most agree that while certain documentation is essential, particularly for longer visa types, the Non-O visa typically does not stipulate a background check.

I used an agent, never required a background check.

Apparently you DON'T need a background check for a Non Imm O visa. I'm not sure where you're getting your info from

I was originally going to apply for a non-O A and that does require a background criminal history check. It is a standard FBI national check and you have to submit fingerprints to FBI to run the check. It also requires a health insurance policy from a Thai provider. An OA is just too much hassle to do. Just apply for the non-O short term which gives you 90 days. You can then get married and leave for a couple days while you apply for the marriage visa after you’ve married in Thailand.🇹🇭

Don’t have to leave Thailand, you were misinformed

Ian Carman I didn’t have the required 800,000THB for the one year retirement visa. Immigration said you can’t convert one visa to another. You have to apply for a new visa online outside the country. My wife is an officer for the Ministry of Justice and I doubt they fed her a lie. A visa stays in effect until you leave the country and to change your visa to another type you have to apply online via e-file outside Thailand as you can no longer apply in person at an immigration office. Changing it after an extension of stay is not the same as it would be a new visa instead of a renewal.

And he seems to think that Pete doesn’t have the 800k

Chris Burns you were misinformed. You could have remained on your retirement 1-year extension, and once you are up from 30 days before the expiry of the extension, you applyfor a change of reason for the next 1-year extension from reason retirement to reason marriage. You were only told to exit Thailand before your 90-days stay permit expired, because you didn't have the required 800,000 THB for the one-year extension in your bank account. People who can fulfill this requirement do not have to leave Thailand and apply for the Non-O Marriage Visa outside of Thailand. They can stay and just change from retirement to marriage when the next 1-year extension is due

But you didn’t explain this very clearly in your original post .It read as if you were advising Pete that he had to leave Thailand to switch to a non o based on marriage

Chris Burns You cannot convert Non-O visas but, once you have completed one extension of stay, for the next application you can change the reason for the extension if you meet the requirements. An extension of stay is not a visa. ;)

You don't need a background check for a 90 day Non-O visa, that only applies to the 12 month Non-OA visa

I’m told to file for a 90 day non o visa to get in and then to file for a non o resident/marriage visa. I will be marrying my Thai gf and staying in Thailand to live out our lives.

Pete Taylor you can’t switch from retirement to marriage visa in country. You will need to leave the country after you’re married and apply for a new visa. I just returned from Laos where I paid the application fee and waited for approval. It only took two days but all paperwork must be submitted via e-file. We had an agent gather and submit the paperwork but you have to pay the fee in person at the Thai embassy of the country you’re in. Once you enter on a retirement visa it stays as such until you leave the country. Once approved you enter Thailand on your new visa. The only advantage for me is I only need to keep 400,000THB in a Thai bank account instead of 800,000THB. You can open a bank account after you enter on a 90 day retirement visa so it can season the needed 60 days but I needed to provide my bank records to show I had the funds in an account for a marriage visa approval. To open a bank account you’ll need a Thai phone SIM registered to your passport and a certificate of residency from immigration. There was quite a list of documents required to submit and we were married at a government office a couple weeks before we went to Laos to wait for approval. It was a nice vacation/honeymoon though so it was a wonderful time.

My point is that you are telling Peter he has to leave the country because you had to .His circumstances might be different to yours so you shouldn’t advise him that he has to do something when he probably doesn’t have to because tbh 800k is not a lot for most people

In your circumstances you had to leave Thailand but the vast majority of people would not have to .So you shouldn’t advise anyone to do what you did when it’s the exception not the rule

Ian Carman that’s all fine if doing it at the one year extension but you have to keep the 800,000 in a bank instead of 400,000. What if he doesn’t have 800,000 to keep tied up in a bank? You also need 800,000 to do the first one year extension. I did not have 800,000 to do the first one year extension. Maybe the original poster didn’t either. Between my military disability, social security and pension I have an income of $7k/mo. but no cash savings after my divorce in U.S. I could not get a one year extension because I did not meet the financial requirements of a retirement visa despite having a steady retirement income.

Ian Carman agreed. I switched from retirement to married and back to retirement again in country. First switch we did ourselves, second i used an agent.

Thank you for the information. I hear and read so many articles about it and some have different details. Congrats on your marriage, I wish the 2 of you the very best! 🙏🏼

if you are over 50 you can apply for a 90 day Non-O visa based on that without being married. Then your 1st 12 month extension of stay should be based on retirement. The 2nd year you can switch the reason for your extension to marriage if you want
