Can I switch from a Non B to a Workcation DTV after living in Thailand for over 3 years?

Can I get a workcation DTV if I have been living in Thailand for 3+ years?

I have a Non B but considering switching to the DTV next time I am back in the UK, but I have some concerns about being asked for additional paperwork, such as:

• Tax returns

• Proof of residence

• Payslips

I can provide all of these, but they would be Thai documents. I'm guessing this would be an issue, and possibly a red flag that I have a history of working in Thailand with a Non B?

I can provide all of the standard documents - corporation certification, letter from company, 500k in a UK account (can provide proof of address in home country with this).

TLDR : Answer Summary
The user is considering switching from a Non B visa to a Workcation DTV after living in Thailand for over 3 years. They are concerned about the need for additional paperwork, such as tax returns and proof of residence, especially since their supporting documents will be from Thailand. Other users caution that switching from a long-term visa with benefits like a Thai bank account to a DTV might not be advisable, and they emphasize the legal restrictions on working within Thailand on a DTV. Users suggest maintaining clean documentation and possibly facing challenges in proving employment and income sources when applying for the DTV.

Do NOT switch from a long term visa with the perks it gives you ( such as Thai Bankaccount) to the inferior DTV tourist visa.

Maintaining a Non B is expensive and a lot of work

Anonymous participant I can help you with that feel free to contact me for further information

I would avoid that. Show UK proof. They will ask for additional documents.

Having been living and working in Thailand isn't an issue but cancel your work permit and extension before you leave Thailand. Have you maintained income from your UK company while in Thailand or is this a new company? A new company doesn't rule out a Workation DTV but without history you are going to have to explain how you will get income, if you have any contracts that would definitely help

Company was registered years ago, income was paid via consulting under a Thai registered company for years. I have the payslips and tax returns for this, but this won't really prove income was generated via the foreign company, just paid out from a Thai company.

Anonymous participant did the Thai company invoice the UK company or are they entirely separate

Yes, they did. Invoiced UK company → then paid the money to me as a salary in Thai.

Anonymous participant perhaps that's your route then. You can show the UK company has income, you can show that income found its way to you. If you can show the UK company was registered with the authorities and paid tax even better

The UK company has revenue and pays corp tax, but I don't think this is what they'll be looking for, won't they want to see salary going from that company into a UK bank acc?

If asked produce documents. Whatever is required. They are more concerned about you not breaking labour laws and providing for yourself. Its painless. Leave a couple of weeks spare before flight.

Some documents I can not provide, like tax return from my home country. I can provide one from Thailand but I figure that could be an issue?

Anonymous participant it will be an issue. Not paying tax in your home country, or any other foreign country, is a big red flag.

I have paid taxes in Thailand for years.

I'm confused. What will you be working as during the workcation? This is what the documents need to prove. So the payslips need to prove that income, not the income from when you were in Thailand on a Non-B. I switched from a Non-o without any problems. For residence proof, a UK driving licence will suffice.

I'd be working for my foreign company that I own, so income will change from salary from a Thai company to working as a consultant for my foreign company.

Anonymous participant then I think it would be best to have a few months track record of this before applying.

From what you are saying, and your history, you are going to have a serious problem getting a letter from the company you work for stating that you can work remotely in Thailand, as on the DTV you can not legally physically work inside Thailand. You can only work for a business outside Thailand, and not doing work in Thailand.

I own the company in the UK, so getting a letter saying I will be consulting for a company I own that has no clients inside Thailand is not an issue. But I do have a history of working for a company inside Thailand, which I guess I would need some letter saying that position has ended and the Non B cancelled?

Anonymous participant do you have current personal income tax filings in the UK. Not business tax filings, but your personal income tax filings? That has a good possibility of being asked for.

No, this is exactly what I am concerned about. I have not been UK tax resident for years. Income tax filings + payslips are all within Thailand.

Apply via soft power, all DTVs are the same unless it says in the remarks.

I don't want to, nor have the time to take weekly classes in things I've no interest in.

Anonymous participant Attendance is not monitored. The DTV is a tourist visa so you will be on holiday every entry.
