Can a foreign spouse of a Thai sole trader get a work permit with no Thai employees?

There was a post recently discussing a foreigner being able to get a work permit based on his wife being a sole trader with no additional thai employees and he was allowed to assist in her business. I recall this had something to do with the wife filling in a particular form, can anyone confirm if this is correct because i think the thread may have been deleted?

In case of marriage with the owner/sole trader you need only 2 Thai staff.
