I AM SEEING A LOT ABOUT TAX LIABILITY OPEN DISCUSSION. I HAVE MY 8 IN THE BANK AND WILL START MY MONTHLY DEPOSITS SOON.
Answer summary
The discussion revolves around tax liabilities for expats in Thailand, particularly focusing on the requirement to obtain a Tax ID and file a tax return if residing in Thailand for over 180 days. Many comments highlight the complexity of tax obligations, especially regarding dual taxation agreements (DTA) between Thailand and expats' home countries. While some share their experiences with tax documentation, others stress consulting professionals for clarity. It is generally advised that expats should be aware of what qualifies as taxable income and the implications of transferring funds into Thailand.

Christer Bau tax rates in Norway is often 55% on high salaries/pensions, by optimisation of what you tax in Norway and what you bring for taxation in Thailand, you get 0% up to a certain amount in Norway, and max tax rate in Thailand is 35 %..I used KPMG to do the work for me, and I belive everyone from my country living here do the same.

Being in TH more than 180 days you are tax liable for incoming money. Whether you have to pay tax or not depends on your countries DTA. But anyway you HAVE to file a tax report. Quite a few as you can see here haven’t understood this. Negligence can be both civil and criminally pursued.

Salary, pension and ”New” money can be taxed. Savings can not.

Is this not correct?

I have transfered alot the last couple of years for investments, but never even thought it could be taxed unless the origin was salary or pension.

Because I have investigated all this before AI existed, but after that I have tested how good answers AI give and how well it understand it all. ChatGPT, Grok is the ones I have tested out and they are very good. In a few issues where they disagree about some detail I let them argue with each other to come to a conclusion. I haven't tested Gemini that much but my impression is that it also is very good, up to par with tax experts.

i got my form downloaded in english , filled it out ( it’s self declaration) got my allowances for being married and health insurance and dta with uk government, handed it in. they said wait ten minutes and came back with a receipt for zero tax liability. you need a TIN number from your local revenue office which is also the same as your pink ID number ( if you have one ) you don’t need to spend time and money in a tax advisor , it’s all self declaration but have proof of incoming funds and tax paid in your own country, ready should they carry out an investigation. and they are investigating big amounts from the chinese etc , not an expat who brings in what he needs to live on.

Facebook IS NOT the place to ask questions like this. You're gonna get answers that vary from "don't worry about it " to "you're gonna owe big."

And unfortunately, if you consult professionals as many suggest, you'll get conflicting answers.

Read your country's tax treaty with Thailand, research as much of this on your own, consult a tax professional, apply as much common sense as you can to all of it, and decide who and what you believe. Good luck.

Simon Roberts 🤣🤣... Not really the last time was a email from them fishing for info (note I said fishing)

they had clearly got my details from my Singapore bank via the CRS stuff

I was very polite, and informed them that they knew as well as I did..I had no direct physical ties to the United Kingdom or assets in the United Kingdom.

Having not set foot on mud island in 23 years, I would be of the opinion and I think they would agree

I was well and truely non-resident for any form of taxation in the United Kingdom...

but if any of my circumstances changed , I would ensure they would be the first to be informed of my pending arrival back in Blighty so they could arrange the brass band..

Never heard from them again...

The last 2 years I took my paperwork to my local thai tax office, my government pension isn't taxable and I already pay tax in the usa so have no liability in Thailand but still had to get a tax ID # and file. Anyway the first 3 people had no idea what i was even talking about, the 4th a supervisor took my papers and said I was good to go. I'm pretty sure as soon as I left she threw them in the trash bin. Oh well, I tried and did keep copies.

Why do you have to have a TIN? If you do not bring an "assessable sum" into Thailand then there is no obligation to register.
Steven ***************
Steven ***************
Roger Lorton You don't have to pay anything but you still need to have a TIN and file if you spend more than 180 days in the Country in the year. The tax revenue offices in the larger cities are more aware of the rules, smaller more remote offices out in the country aren't as aware or don't care so much. Anyone that lives here brings in more than the minimum assessable amount, but for most it is exempt from double taxation.
Graeme *******
Graeme *******
Steven L. Daugherty little bit different for done the same for last two years first year owed them 514 baht this year nil but as you say have a TIN number and file a return as required by staying here 180 days. Didn't even use the DTA with NZ as many excemptions can be claimed plus had my printout from.BKK Bank but just wanted total bought in to Thailand.
Roger ********
Roger ********
If you stay more than 180 days in Thailand you automatically qualify as a tax resident. However, you do not need to register unless/ until you remit into the country an "assessable sum". Then you have 60 days to register and must submit a tax return before the following April. No "assessable sum" equals no need to register. That is the current law. What qualifies as an “assessable sum” is determined by many factors, not least the Double Tax Agreement between Thailand and your country. So, the first decision falls to the tax resident - do you, or don't you?

Tax liability is both a simple and a complex issue:

Do you spend 180days + in Thailand in a tax year,

No? No liability

Yes? You need a professional. Being liable does not mean you actually pay- go to professionals..
Guz ********
Guz ********
Robert Gillespie Good answer but as you say you need a professional. 😉 If I'm resident in Thailand for < 180 days but still derive income in Thailand (rent etc.) I'm still subject to filing a tax return as long as my income is over 120.000 Baht per annum.
Robert ***********
Robert ***********
Guz Tolput you are.

I am covering 97% of cases with a broad sweep. You seem a sharp guy- more than capable of looking after yourself.

My big point is that if you live in Thailand and there is no question about residency, then get an expert because residency and potential liability may very well equate to 0 liability for tax.

You are buying expertise and peace of mind. Tax compliance will be next big issue. However, I am guessing the issues with nominees and general bad behavior will take some t in me to resolve (mostly seems sensible to me).

There is going to be a downturn in both tourism and immigration 2-5 years. This pause may very well give the Government time to build some firm foundations going forward.

Thailand has a dual tax agreement with 60 countries

Unless you are bringing in excessive amounts of money from investments to Thailand - no need to worry

If you already have 800K Thai baht in your account , just bring in what you need for everyday living

In regards to a

Thai Tax ID

If you want to get one - it’s 100% FREE

Don’t get stitched up

It's quite simple 180 days in country you are resident for tax

If your income /pension is taxed at source before bringing it in you will just claim a tax credit on your Thai tax form

If not taxed at source refer to your countries DTA with Thailand, your specfic income may be exempt from Thai tax, ie UK civil servants pensions as one example

If not exempt you will declare and pay tax on that money via the Thai Tax PIT table

That's a simple summary

Yes you can stop lying...even holding a, saving account is subject to tax on the interest and many people on retirement visas have tax numbers for that exact purpose... So please stop lying

OK so you pay at source so what ..❓

You are still tax resident after 180 days and still are required to submit a tax return and claim that income as a tax credit on your tax return

Failure to submit a tax return you are subject to fines and investigation

And it's. DTA not a DTT get you acronyms correct at least son 🤦

And no the UK /DTA doesn't exempt pensions anything except civil servant pensions

Clearly you don't understand anything about multiple tax jurisdiction do you ❓ .. 🤦

I can cite the tax code if you like.. ❓🤦

And if you don't pay at source and remit that income to Thailand you are likely liable for Thai tax exactly as I stated 🤦

Not an accountant champ just someone who understands how multiple jurisdiction tax works and how it's viewed having worked under them for most of my career

I work because I choose too princess.
