What are the current requirements for obtaining a Non-B visa from the Thai consulate in Hong Kong, particularly regarding the Work Permit 3?

Has anybody got recent experience on getting single entry “Non B” from the consulate in Hong Kong.

Mainly if they require the WP 3 ??

I emailed them as I am preparing documents for a member of my staff and received a slightly conflicting/confusing reply

This was at the bottom of email after listed documents

In order to expedite visa issuance, your employer may, on your behalf, apply for the Work Permit in advance (with the form called Tor Thor 3). The Department of Employment will then issue a pre-approved certificate to be used in your visa application. In such case, please make sure to obtain the Work Permit (Tor Thor 2) once you arrive in Thailand.

I would think an enterprising person could establish - say - an Export / Import company in their home country. Then tailor it to meet the requirements of this Thailand 3 year Multi Entry B Visa with all necessary documentation. Then roam all over Thailand looking for - testing and evaluating items for Export and Import

There may be another reason that the Thai Embassies/Consulates in HK and Saigon will process a B Visa App without a WP. 3 is somehow magically these Consular Directors and Staff acquired common sense - seeing clearly that requiring a person to Exit Thailand - wait for one to two weeks in that country for a Third Party (Visa Agent - Accountant / Lawyer to take the WP. 3 Application and photos of your Exit and Entrance Stamps to the Labor Min - have the LM accept the App - provide a WP. 3 Receipt - then the LM takes a full 5 days to provide the official LM WP. 3 issuance letter - then the Visa Agent sends it by International mail to the B Visa Applicant in Malaysia - Laos - where ever - ALL so the B Visa Applicant can then turn it over to the Embassy/Consular Staff - then wait about 28 hours more to get a 90 day B Visa... All of which is an asinine - ludicrous - ridiculous process. I would like to know if the acquisition of common sense shown by the Thai Consular Staff in HK and Saigon was caused by a virus so that I may get some and infect the Thai Consular Staff in Laos and Malaysia with this magical common sense virus.

These rules were put together originally many years before the advent of the Internet, video teleconferencing, email, Secure Internet signatures. We are at an age where complicated multi-party mortgage loans can be signed and legally executed by signatures done on the Internet but process a B Visa by 20-30-40 year old technologies. A color PDF - Portable Document File file is 99.9999% the same as an original document and has secure signature capability. PDFs are used by the tens of thousands ( maybe hundreds) of times daily around the world to execute signature binding documents BUT cannot be used to securely transmit a completed WP. 3 and Official Letter to a Thai Consular services office in Penang or anywhere. This would save 3 to 5 to 7 days on the wait time for B Visa processing in a regional country. Several people have tried it in Penang and their application was thrown out. It is easy to do... Only a scanner is needed with the Free software that comes with most scanners. But Snail Mail wins the Marathon for endurance.

I wonder how many visiting businessman actually bother if only for a few days or meetings, especially as any big company will have a friendly relationship 😬 with local authorities that will protect them 😂

WP 3 is made for the foreigner who not yet entered Thailand. By using it for people who entered Thailand without the correct Visa makes it the problem. It used to be, apply WP with WP3 forms, get the papers and go to a consulate or embassy. Labor office now makes it more difficult and will not give the paper directly but after a week and want to be sure the foreigner is abroad during the application process.

I know what you mean Sean from your previous remarks. I can only guess such a B Visa for assessing business opportunities, factory sites, etc. are still issued but I have no personal knowledge of such. It would seem to be rare these days. Maybe it is one of the 10 WP.X at the Link Tod posted.

A stamped successful WP Application Receipt called a WP. 3 with an Official Labor Ministry Forms Letter that comes up to 5 or more days later neither of which will be generated until the Applicant proves that he is out of Thailand. Then when both are finished and given to a Visa Agent who sends them by International mail to the Applicant. The B Visa Applicant then presents these documents along with the entire Application Documents package to the Thailand Consular Staff. No WP. 3 - - the B Visa is not processed in most countries

You used to be able to get a one year multi entry B visa without a work permit, then a few years ago they changed the rules and you can now only get a single entry non b if you don't have a work permit.

I just think how much more enjoyable a few days in HK would have been (for less money) rather than 15 days in Savannakhet

More likely JD they just haven’t caught on to the new laws the others are applying, I have noticed even embassies in Europe now include it on their list of required documents, I suggest we enjoy this moment of common sense and convenience for as long as it lasts, if they start getting huge numbers of applicants it could change quickly

I applied recently (a month ago) for my second non b from Saigon. I had no WP3 (whatever that is). Just the invitation letter and all the regular company docs.

The embassy staff who took receipt of my second application was less laissez-faire and quizzed me about not having a work permit. She also insisted on seeing a flight out of Thailand which meant I had to buy one (which I probably won't use).

I'm guessing 2 non b is the limit. So my next visa will be a tourist visa from HK.

Good to hear that there might be another option. You never know if it is embassy policy or just a lax officer. In HKG, it is the way they have been operating for at least the last 3 years.

I have personally applied for non-B visas 3 times. I last had one of my staff apply in July. HKG is the only neighbor country that does not require a WP-3/letter of approval to issue a non-B. You need to submit an invitation letter, signed by company director and with company stamp, a current certified DBD registration statement, a copy of your passport ID page, 2 passport size photos, a visa application which they give you when you check in at the information counter, and a copy of your HKG entry visa ticket. Most importantly, HKG is interested in your visa fee, which is why it is the best neighbor country embassy. After you get the OK at the information counter, pull a queue ticket. At the application counter, they may question you, asking if you are a HKG resident, but ultimately they just want your money. Apply before noon, and pick up next day before noon. It's a well-organized office without long queues. I know they list a lot of other company documents as requirements on their website, but in 4 times through the process, they have never even accepted them for review.

They only need an invitation letter. A guarantee letter states purpose of trip, where the applicant will stay, dates of trip and guarantees payment of all expenses. It is more applicable for short-term work assignments.

We have all required documents as we have 4 WP already but it makes life easier to do without the WP 3

But I’m puzzled as to what the difference is in these 2 requirements, is it not the same thing a signed, stamped invitation letter ?

- An original letter of guarantee from the employer with authorized signature and Company Seal Stamp with details about the purpose of the visit to Thailand and a copy of the company registration. A copy of I.D. card of the authorized signatory is also required

- A letter from the Thai Business Counterpart with authorized signature and Company Seal Stamp, stating the details about the visit to Thailand.
