Hi all..

We're are looking to have a staff member working remotely from Thailand under the DTV for 12-18 months

Hes a Brit, currently based at our London office, but we need him to provide surge support to our Sydney office for the next year or so. The Thailand timezone with a degree of overlap with both UK and Australia is ideal place to put him.

The application process appears straight forward enough online, but I would like to hear from those who have recently gone through the process as to the reality of it all.

> The THB500k capital requirements particularly. Im assuming the 3 month incubation in the individuals account ahead of application id strictly enforced?

> Atbthe 180 day milestone, are same-day border bounces acceptable for DTV (I know immigration has crackdown on this for vis tourists) or do you need to be out of Thailand for a longer period befor reentering?

> How are others navigating the practicalities of triggering Thai tax residency after spending more than 180 days in the Kingdom in one tax year?

> Any other potential curve balls we should be aware of?
Answer summary
A Brit is considering working remotely from Thailand under the DTV visa for 12-18 months and seeks guidance on the application process, particularly regarding capital requirements, tax residency implications, and the practicality of border runs. Responses reveal variability in the capital requirement enforcement and suggest that tax arrangements should favor Thai residency to minimize tax liability. Concerns about obtaining a Thai tax ID without a local payroll and the complexities of tax residency after 180 days are highlighted, as well as the recommendation to consult with tax professionals for tailored advice.

You can't apply, the member of staff must apply. London doesn't require 3 months seasoning just having it for a few weeks is normally sufficient. The employ will need to have a contract, show payslips and a letter specifically giving him permission to work remotely from Thailand and stating that he won't interact with any Thai entities or clients inside Thailand.

it would make a lot more financial sense for him to be paid as non-UK resident (as he won't be) with no UK tax and for him to pay Thai tax, as Thai tax is only due on the money he brings into Thailand.

Seek consultation on it to be sure but there no point him continuing to pay UK tax when he's not actually UK resident but is Thai resident. If he's not UK resident he doesn't have to pay UK tax, it doesn't matter that the company paying him is in the UK.

The 100% legit way to do this is he is Thai tax resident and no longer pays UK tax. It's also the way that results in a much lower tax bill, as he only needs to pay Thai tax on money he actually remits here for living expenses.

Continuing to pay UK tax, you are faking his residence as the UK when it's not, I don't see the benefit in lying to the tax authorities simply so you can pay more tax you aren't liable for.

OP
Mr 5 Bank Accounts Correct. After informing HMRC upon depature will cease being a UK tax resident for income tax purposes and have a NTC applied to his UK payroll. He is obliged to continue to pay NI however via Class 1 deductions for one year, after which he can move to Class 2 NICs if he wishes. Up to him to action directly with HMRC. He will become Thai tax resident after more than 180 accumulatively in Thailand within the same financial year and will need to submit annual tax fillings to the TRD against his annual assessible income

The 500,000 depends completely on the embassy that the application is processed by. Some want 1 month, some want 3 months, some want 6 months. Some don't even care if you can show them a statement from yesterday with enough money that was deposited the day before.

Same day border bounces shouldn't be any problem.

London Embassy often does not require 3 month seeding. Fly out and back in is not an issue. Tax is a little more complex. Yes Tax Resident after 180 days but if no assessable income no need to file a tax return. Will you pay him as normal to a UK account on PAYE or other arrangements?

yes he'll remain on his UK contract paid via UK payroll in GBP into his UK account

Anonymous participant So the money that is transferred into Thailand will be assessable once tax resident but will also be subject to the UK Double Taxation Agreement. Get real advice but I think it would just be the differential in tax rates after any deductions. It is nothing I would think would constitute a blocker.

JellyfishUmbrella09 well this is exactly what im seeking real-world experiences from the group on. Clearly the "Workcation" category is set up for remote workers and assumes (and assesses eligibility against) international employment.

But there is little info I csn find on the high likelihood of DTV holders eventually triggering tax residency in Thailand and so the mechanics around obtainjng a tax number and filing annual tax returns

Anonymous participant the DTV is technically a tourist visa that doesn't even allow to open a Thai bank account. I've seen people mention they've applied for a Thai tax ID and were rejected on that basis.

Your best option is to talk with a taxation specialist that's knowledgeable with both countries.

Anonymous participant The best way would be just to pay an agent or accountant to get one. It is not expensive and it is guaranteed. DIY has mixed results as it depends on the office and the staff. My advice it avoid the headache and just get it through an intermediary. It will only be a few thousand Baht.

Yes his international remittances GBR>THA will be taxable as will his in-country benefits... but its more the Thai end tax mechanisms I have questions about.

How does he obtain a Thai Tax ID without being on a Thai payroll? Is that issued with DTV (presume not) or does he need to obtain from the revenue dept once he hits the 180 threshold.?

Anonymous participant Check his liability on Thai tax if not paying in UK. Remittances to Thailand may be assessable and no recourse to the UK DTA if not paying tax there. Banks also want to know your Tax ID. My UK, Thai and Singapore banks all want to know where I am Tax Resident.

given the duration, he will inform HMRC ahead of time but should cease being the UK tax payer for income tax purposes fairly immediately. Only NI. But yes well pay for him to receive tailored tax advice on his specific circumstances
