Why was my Vietnamese wife questioned at Thai immigration while I had no issues?

So my Vietnamese wife and I stayed the better part of 4 months last year, broken up by a 3 day trip to Phom Pehn so as not to overstay 60 days.

This year, I encountered no problems entering again on a normal 60 day visa (US passport). However, my wife, traveling separately from HCMC, was detained and questioned, resulting in them making her sign a statement agreeing to leave after 3 weeks. Yet they still stamped her passport 60 days.

Something about if she wants to stay longer, then apply for a visa.

As far as I can tell, we have done nothing wrong. I want to stay 60 days, but she is terrified of issues if she doesnt depart as agreed.

What do you make of this ? She is afraid of blacklisting.
Answer summary
An expat shares concerns about the differing treatment at Thai immigration between himself and his Vietnamese wife. He was allowed entry without issue on a 60-day visa, while his wife was detained and made to sign a statement agreeing to leave after 3 weeks, despite her passport being stamped for 60 days. Community members discuss the implications of her situation, suggesting she should comply with the agreement to avoid future issues, especially given her nationality. They emphasize the tightening of immigration scrutiny, particularly for back-to-back entries, and advise planning for a proper visa for longer stays.

Question. How easy is it for your wife to enter your home country these days?

Get real Brad. I’ve looked through most of this post and the replies, so I’ll summarise things and not repeat the good advice you’ve already been given:

1. You are not behaving like a tourist and your Vietnamese wife has been identified as being a suspicious entrant to Thailand this year.

2. As a result you are now having a hissy fit because your completely flawed plan has collapsed. What was OK last year isn’t going to work this year.

3. You seem oblivious to the fact that the U.S.A. Is not the centre of the Universe and that World affecting events happen elsewhere, which can have an effect on your plans.

Advice:

Get up to speed with the situation you are in and make new plans. If you still intend to spend time in Thailand this year and find planning overly complicated, visit a visa agent and preferably one with a legal department, and see if they can assist you.

Donald Campbell I already booked a flight out. I have no problem spending $$ for the next 3 mo in Cambodia and Vietnam. Does this impinge on me? Not at all. Do Thailand tourism businesses lose in the end? Well duh. But you go right on lecturing if it makes you feel smug.🤣
Donald **********
Donald **********
Brad Smith I’d listen to your wife. She seems to be a lot more clued up and regionally aware than you are. As for continuing your hissy fit and boycotting Thailand for Cambodia? Knock yourself out! I’m sure the Thai economy won’t collapse as a result.
Brad *******
Brad *******
OP
Donald Campbell of course it won't. But if they're going to adopt tourist unfriendly policies, it's certainly not going to help a tourist dependent economy. Visiting a country for a couple months a year is a far cry from living there. All you can do is rent hotels and Airbnb's. That doesnt spell resident.

The big concern for the Thai government is people working illegally. That’s why she and others are being questioned. They want legitimacy.

Brad Smith look I don't claim to know a lot about emigration or the like but it would seem like you may have problems in the future if you dont comply.... but maybe take a day to ho to the emigration office so you can have some advice from people who know what they are talking about rather than people sitting on their toilet with their phones handing out advice that comes to them off the top of their heads 🤷‍♂️ at least you will have piece of mind

Yes the process has tightened up . Probably trying to stamp out illegal workers . The 1 year reset is your 12 month entry not a calendar year . Remember we are privileged visitors and as guests we need to respect our hosts . Unfortunately many guests have abused this by bad behaviour or not obeying Thai law . This is now making life difficult for those doing the right thing .

Brad Smith from my understanding you can do it 2x with a short break but you need a long break in between your next visit that looks you went back home instead of living there. And even after you come back, you can't do the back to back again. And if your wife is a Vietnamese citizen, they're even more strict on the back to back.
John **********
John **********
@Brad ******
that depends to a great extent on your history in Thailand. A new year makes no difference. There's also no limit on visa exempt entries, it's entirely down to history and the immigration officers view of that history
Stephen *******

Brad Smith depending on which country you have citizenship and a valid passport with minimum 6 months left on the passport.

Brad please! Do some reading. This will inform you that immigration are enforcing the terms of entry/visa definitions. If your behavior (travel history) is such that it might be reasonable to infer you are not a genuine tourist but in fact closer to a resident (or something that requires a visa) then they can find you are not a tourist and are abusing the visa. Reading would also show that it is increasingly normal for immigration to closely inspect your visa history, particularly if you are an irregular visitor (not a typical tourist).

Only Thai citizens have an automatic right of entry- everyone else must understand and respect the terms of entry.

it was very necessary! Your original comment was asinine and without any value. Being a troll in Thailand is expensive. Have some respect for Thailand and the right of the Thai people to determine how their borders are managed. It not as if they were sending bands of thugs, murdering people in the streets, or raping them in concentration camps.

Robert Gillespie so visiting yearly as a 60 day tourist is now suspicious that one is a resident? One can read everything and still be subject to random categorization, evidently. Im aware Thailand is pushing visas. Its not that they dont want you. Evidently they want your visa money. However an annual visit does not a resident make, by any means.

Brad Smith listen, you are a guest, you don't get rights just because you have a visa. You are permitted entry at the discretion of the border officers.

Brad Smith The treatment is not random. A male westerner entering from the US is not scrutinised as closely as a solo female traveller from a nearby country despite having the same entry histories. Also different IOs use their disretionary powers differently. Yes they can do that, it's their job.

BTW, neither of you purchased a visa did you?

Brad Smith No, he just wants to feel important by declaring that he somehow represents the government and sides with their abuses when he is is just another foreigner who follows the rules verbatim out of cowardice that he might somehow get in trouble. As a child he probably tattle yelled in his friends and school mates.
Robert ***********
Robert ***********
Brad Smith staying 4 months is not the behavior of a typical tourist- hence you are flagged for further enquiry. It’s that simple. Your wife’s situation is complicated by her nationality but the general principle holds.

Immigration also find visa runs are a red flag. They are not pushing visas-Thailand can survive well without 1900baht- they are confirming your visa is valid, having regard to all the circumstances. Different immigrant officers can view things differently-entirely typical for every border I have ever travelled through.

Thai (and expat) social media and news is flooded by examples of foreigners behaving outrageously- ultimately, strict enforcement of visas and entry conditions is in the interests of all genuine tourists and residents.

Your wife’s was fortunate she was not entering the US- starvation, rape, murder, and extended periods in concentration camps seem to be normal now.

It is entirely rational given all the circumstances. As a Viet passport holder she is entitled to the 60 days (and was stamped as such), but there is increased sensitivity because of the crackdown on scams and human trafficking.

The reduction to 30 days reflects the possible/probable reduction. From immigrations PoV they are screening for scammers and when they are content, they reduce the risk further by imposing conditions of entry (well within their power). Many Viet passport holders have been detailed or turned around.

Hope that helps!

Robert Gillespie I wasnt flagged at all. I went through immigration in 5 minutes no questions just 2 weeks ago. It was my wife who was detained and told to leave in 3 weeks randomly. I would be traveling with her back to Vietnam as she has agreed to do...

Otherwise she may have further problems in the future...

The immigration officer has probably made notes in the system about her agreement to leave so I wouldn't push my luck..

You always enter at the discretion of the Immigration officer you are dealing with on the day and don't give them any reason to doubt you may not be not genuine tourists..

That was my first thought as well. That they possibly thought she was working here. Not necessarily as a sex worker….but working in some capacity. As you say, next time travel together and it will probably go more smoothly. There was another recent post….maybe in this group..can’t remember…from a guy who traveled separately from his Cambodian girlfriend and she was denied entry completely. So thai immigration is cracking down on everyone. Not singling your wife out necessarily.

you didn't have a Tourist Visa (TR). That is something you must apply for online before you travel to Thailand as shown in your screenshot above. Not sure why you keep conflating a tourist exempt entry where you get stamped in for 60 days with a tourist visa where you also get stamped in for 60 days but the 2 are NOT the same

it's surely not helped by you consistently referring to a visa when in fact you are talking about entering without any visa at all. "Somebody else" was wrong, there is no reset, immigration does tend to look back a year or so but there is nothing stopping them looking further. If you have valid questions about Thai visas please feel free to ask but there's little point in just going round the houses
Brad *******
Brad *******

@John *********
sonebody else just stated the the tourist visa reset is every 12 months, not every new calendar year. That would make some sense as we departed Thailand last June, only 9 months ago. That seems to be the key as to why they detained my wife ( although not me, as we traveled together).

Sorry but it's inordinately difficult to get factual answers to Thailand visa questions.
John **********
John **********
@Brad ******
you had NO visa, you entered on a visa exempt stamp. Visa exempt entries are designed for short term tourism, they are not intended to allow you to spend extended periods of time in Thailand. There is no defined limit on visa exempt entries just as there is no reset interval. Every entry is judged on it's merits by the immigration officer you stand in front of taking into account your prior history of time spent in Thailand, as a general rule they are mainly interested in your prior history over the last year or so
Brad *******
Brad *******
OP
@John *********
we have no visas. We simply visit 60 days and leave as the system permits. Last year we entered twice broken by a 3 day trip to Cambodia. I had no trouble entering again this month but she was detained.
