What should I do if my volunteer visa application is delayed and I have a flight booked to Australia?

Good afternoon,

Would greatly appreciate some advice on my interesing situation

Firstly- I am a volunteer teacher who has previously had 2x 3 month Non Im o visas :)

I returned from Australia and was stamped in on 8 Jan 2019, so my 3 month is good until 7 April.

My foundation then began an application for a 12 month volunteer visa at end of January. and I booked a flight back to Australia that departs Bangok on 1 April to visit my aged father. Assuming that 2 months would be long enough for the paperwork.

Problem is as of today, I am stil waiting for the 12 month visa.

( I believe my application is awaiting the Tak governors signature on a socail services paper.)

My organisation is telling me I should not fly, and should just wait for the 12 month, even though it may not necessarily come through before the expiry of my current 3 month Non O visa.

Not excited about that prospect and forfeiting an airfare, or paying out a lot for a change, not to mention a week of a three week visit.

They also tell me I would be ineligible to apply for another 12 month visa upon my return, end of April, as the government alreay considers they offered me one, and I refused. Thus I would have to go back to applying for 3 months. This involves further work for them, which it appears they are unhappy to do, and I am sure I will end up paying for.

Is there away around this challenge??

Why not apply for a 12 month non imm. visa from the embassy in Canberra? You can post the application to them and they usually turn them around and post back quite quickly.

The info I was told was that I can't get a 12 month in Australia, I'm based in Brisbane, but I'll definitely call Canberra and check when I'm home ๐Ÿ˜Š

It's listed as an option on their application form. I know that the Melbourne Consulate use to give these but now you need to go thru Canberra for 12 month visas (I think Sydney also does them but I haven't checked). I would suggest

I dont think they'll issue a multi entry Non Imm O based on volunteering, I dont know any Consulate that does.

It seems you confused about different organizations. Your volunteer organization is still waiting on documents from the Governor, social security office and who knows what more they still need to get. Your volunteer organization can tell you they approve that you can stay with them one more year, but only the Immigration Office can give you the needed 1 year Extension of Stay if you and the volunteer organization apply for this with all the documents needed to meet the requirements. Reading they do not have these documents simply means they did not apply for this 1 year Extension of Stay and are still in preparing mode.

Thanks Robert, you are right I was confused. I see what you mean now. :) I don't think my organisation will be too excited about me asking to get a new set of papers, and I'll pay for them too, but I can't delay the flight, to them, that should be choice, but that really can't happen. Thanks for you counsel :)

I would say, seeing the importance to visit your father, go and visit him. Get the documentation from your organization to apply for a new Single Entry Non Immigrant O visa based on Volunteer as you did before. And use this to come back to Thailand and than when your organization has their documents in order apply for the 1 Year Extension of Stay at Immigration Office.

Alison Whebell As Robert says the Immigration office has not approved your extention of stay, wherever your paperwork is now it's not at the Imm Office. Take Roberts advice, get another visa when you return home and apply for the extention after you return.

If Immigration Office approved your Extension of Stay it is stamped inside your passport with a permitted up to date 1 year later. Than you just get a re-entry permit.

I guess you mean that your organization is trying to get the documents together and than apply for a 1 year Extension of Stay at local Immigration Office.

The day you walk in at Immigration Office to apply for an Extension of Stay, the decision is made directly. Or you get the 1 year stamped in your passport or it goes 30 days under consideration, stamped in your passport with a date that you have to come back to collect the remaining 11 months.

No, all the paperwork has been submitted. Back at end of January. It has taken this long apparently to get a check by the police department, social department etc. I am just physically waiting for the application to be signed, returned to the social department, then back to my organisation. Apparently we then visit immigration, and it will be approved.

The issue is receiving it in time, before my booked flight

In my experience if you leave while waiting for the visa to be granted you forfeit the visa but it's ok to overstay if you're waiting for a visa.

If your application is already at immigration and waiting for approval, then you wouldn't be on overstay.

But as Allison wrote, she thinks that they are waiting for some documents that the provincial governor governor sign, that makes me 99% sure that her application still haven't reached Tak immigration office in Mae Sod.

perhaps a terminology issue. I was waiting for a response from Bangkok, but the immigration officer said it was ok to overstay in such circumstances.

Besides, If your application has been submitted to Immigration then you'd be 'under consideration' and not on overstay anyway.

Yes I guessed that was the case. But delaying my flight for a week, or even longer really isn't option I'd choose. My Dad is quite unwell
