I purchased an 18 million baht villa,4br 4 bath 15m private pool 2 years ago in my Thai wife's name .I am 70 and she is 62.I have a Non-O retirement visa. What happens if she dies before me (unlikely,I know)?Thai will leaving the property to me a possibility?I have received advice from every farang expat sports bar in Phuket and the responses have ranged from " you fckn idiot" to "I feel very sorry for you,I hope her family enjoys moving into your home".Anyone have a teensy weensy bit more optimistic advice on what I could do?😁
Answer summary
This post discusses concerns regarding property rights for a foreigner in Thailand whose Thai wife holds a villa in her name. The main issue is what would happen to the property and living arrangements if the wife passes away first. Various comments suggest legal avenues such as establishing a usufruct (a legal right to use and enjoy the property during one’s lifetime), having a will that specifies inheritance, and signing a 30-year lease to ensure long-term living rights. The importance of consulting a lawyer for proper legal arrangements is emphasized to avoid negative outcomes and ensure protection of one's rights.

Go to a lawyer get an agreement drawn up if the wife dies first you get to live in it for the rest of your life you decide who lives there during that period. When you die house reverts to whoever your wife decides as she is the owner and you care you will be a puff of smoke in the chimney

Usufruct and superficies are the way forward. Brief description below both are perfectly legal and I would suggest you do your own research on both, then contact a competent property lawyer.

Superficies:

Under the civil law systems—such as those in Thailand, France, and Germany—a Right of Superficies (often called สิทธิเหนือพื้นดิน in Thai) is an agreement that allows one person to own a building or plantation, while another person owns the underlying land.

It allows individuals (such as foreigners who are restricted from owning land in Thailand) to legally own the villa or house they built on leased land outright.

Usufruct:

While it shares similarities with the right of superficies, usufruct provides enjoyment and usage rights rather than physical ownership of the structures. It is one of the most common legal tools used by foreigners to secure lifelong residential security over land they cannot legally own directly.

So Usufruct contract for the land and a Superficies for the house or building on the land.

Your wife should definitely make a Thai will. Without a will, the division will follow the legal split.

1. In the will, she can leave the house/building entirely to you. (The land may still be subject to restrictions.)

2. If she wants to ensure you can live in the house after her passing, she can grant you:

◦ A usufruct (lifetime right of use)

◦ A habitation right for life

◦ Or a 30-year lease agreement

3. These rights remain valid even after her death.

4. Contact a Thai lawyer who is familiar with inheritance and property law.

Here's the example:

If your Thai wife passes away without a will and you have no children, but she has 2 siblings, her estate is divided under Thai law as follows:

According to the Thai Civil and Commercial Code (intestate succession):

• No children

• But there are full siblings

→ You, the surviving spouse, receive ½ of the entire estate.

→ The remaining ½ is divided equally among the siblings

This applies to all of her property (house, land, money, etc.), except where Thailand's foreign ownership restrictions prevent your permanent land ownership (explained below).

⚠ Important: Land Inherited by a Foreigner in Thailand:

Even though you are entitled to a share of the inheritance by law, Thai land law restricts foreign ownership.

This means:

✔ In principle, you can inherit the land

but

✘ You may not be allowed to keep it in your possession permanently.

The general practice is as follows:

• You report the inheritance to the Land Office after the estate administration is complete.

• They may allow temporary possession of the land.

• Later, the Land Office may require you to sell the land within a specified timeframe (e.g., 180 days to 1 year).

• You get to keep the proceeds from the sale.

The building (house) is a separate asset, and you can inherit and own the building even if you cannot own the land it stands on.

Houses and Villas (Leasehold)The Rule: Since foreigners cannot own land, buying a house, villa, or townhouse requires a dual-structure agreement. You can own the building (the structure) itself, but you must lease the land it sits on.The Lease: Land leases are legally capped at a maximum of 30 years, though renewal options (such as 30+30+30 structures) are commonly written into the contract.Building Ownership: You can legally register the house in your own name at the local Land Office, ensuring you own the structure even if the land is leased.

Go see a lawyer, it's cheaper than you think. You need both the usufruct and a Thai will for her. She can leave the property to you, even though it will never be registered in your name. You have a set period to sell or transfer. Even if you sell the Usufruct is valid until the end of 30 years. This means you can live on in the house. We went and paid a lawyer and this is what they setup. Honestly I do not care what happens after I die, the house is hers to do as she wants after all she paid for it anyway. I just wanted to be protected in case something happened to my wife so me and the cats still had a home, I do not need protection from my wife.

Can I register a usufruct right for my foreign partner?

Yes. Under Thai law, you can register a usufruct right for your foreign partner, even though foreigners generally cannot own land in Thailand.

A usufruct gives the holder the right to:

* Live on the property

* Use and enjoy the property

* Receive benefits from it, such as rental income

The usufruct can be granted:

* For a fixed period of up to 30 years, or

* For the lifetime of the usufructuary (your foreign partner).

The registration must be made at the Thai Land Office, with documents such as:

* The original land title deed

* The landowner’s ID card and house registration

* The foreign partner’s passport

* An interpreter, if required by the Land Office.

Please note that a usufruct does not give the foreign partner ownership of the land. If the land is sold, the new owner must still respect the registered usufruct until it expires or ends according to its terms.

Inheritance by foreigners in Thailand

Many people raise the question of whether a foreigner can inherit in Thailand. According to section 1639 of the Code, a foreigner can inherit from his spouse who is a Thai national. According to clause 93 of the Land Code, a foreigner that acquires property by inheritance in Thailand can have ownership over the property only after receiving approval of the Minister of Interior. It must be noted that the share of the foreigner must not exceed the limits described in section 87 of the Code.

That gives you some research material if you are named in her will and it is registered properly.

I love this one, doing your due diligence after signing the contract.

I don't know where you are from but would you have considered buying à house worth that mych in your home country without checking with a lawyer? You already knew that you could not buy the house under your name.

I will say something that will sound mean but it's not intended that way. Your experts at the local bar could(not necessarily) be right and the problem doesn't stop only at if she dies before you. What happens if she find somebody else? If she gets sick of you?

Having sais all this, I would go see à real expert, one with à degree and get à leasing agreement from your wife and hope she agrees.

🏠 Can you inherit the villa?

Yes, you can inherit it, even as a foreigner.

But there’s a condition:

* As a foreigner, you cannot own land long-term in Thailand

* If you inherit it → the authorities usually require you to sell it within 1 year

👉 So:

* ✔️ You can receive the property

* ❗ But you can’t keep the land indefinitely in your name

⸻

📜 Thai will (very important)

Your wife can legally make a Thai will and:

* Name you as the sole heir

* Prevent issues with her family

👉 If there is no will:

* The property is divided among legal heirs (children, parents, etc.)

* That’s when the problems you’ve heard about can happen

⸻

🧾 Best protection: usufruct

This is the key tool.

A usufruct (สิทธิเก็บกิน) gives you:

* The right to live in the property for life

* It is registered at the Land Office

* It remains valid even after your wife passes away

👉 This means:

* Even if ownership goes to her relatives

* They cannot force you out

⸻

🏗️ Additional protection: superficies

With this:

* You can legally own the house (structure), not the land

* It strengthens your legal position further

⸻

📑 Extra layer: 30-year lease

* Can be officially registered

* Gives you long-term living rights

* Often combined with a usufruct

⸻

⚠️ Worst-case scenario (if nothing is arranged)

* You inherit → must sell within 1 year

or

* Family becomes co-owners → possible conflicts

⸻

✅ Best-case scenario (with proper planning)

1. Your wife makes a Thai will

2. You have a lifetime usufruct

3. Optionally: superficies or long-term lease

👉 Result:

* You can live there peacefully for the rest of your life

* No one can remove you

⸻

👍 Bottom line

* You’re not an “idiot” — this is a very common setup in Thailand

* There is a solution, and it’s fully legal

* You just need to arrange it properly and in advance

Brilliant*********
Brilliant*********
Petrov Petrov Fantastic answer thank you. If I can ask, do I get a usufruct from land office, local government or do I need to amend both our wills?
Petrov ********
Petrov ********
BrilliantShark3683 1. Usufruct is registered at the Land Office

* The usufruct must be formally registered on the Chanote (land title) at the Land Office (กรมที่ดิน)

* It is a real right over the property, meaning:

* You can live in the property for life (or fixed term)

* It remains valid even if ownership changes

* Both you and your wife must go in person to register it

👉 This is the strongest protection you can have as a foreigner.

⸻

2. A will does NOT create a usufruct

* A will only transfers ownership or rights after death

* It does not automatically grant you a usufruct

* Even if your wife writes “he can live there,” it still:

* Needs probate

* Can be challenged

* Is weaker than a registered usufruct

⸻

3. Best practice (what experienced expats do)

You should ideally have both:

✅ A registered usufruct

* Done now at Land Office

* Gives you immediate, enforceable lifetime rights

✅ Wills (both of you)

* Your wife’s will can:

* Confirm your right to stay

* Leave the property (if legally possible through structure)

* Your will covers your assets and avoids complications

⸻

4. Important details

* A usufruct can be:

* Lifetime (most common)

* Or max 30 years

* It ends when you die (not inheritable)

* Costs are low (usually small government fee)

⸻

5. Reality check (important)

Without a usufruct:

* If your wife passes away, the property goes to her heirs

* You could lose the right to stay unless they cooperate

With a usufruct:

* You are legally protected to remain, regardless of heirs

If if a sale is important it may have to be transferred under another Thai name before her passing, secured with a 30-year lease. The government is currently clamping down on consecutive leases, if you have an heir the land can be put in the Air's name for the duration of their lifetime, only.

Based on my situation

1. I currently have a usofruct in place, was arranged through lawyer when we purchased the house

2. Wife has also made a will with the lawyer stating that everything shall come to me in the event of her passing.

In the event of her passing I must sell within a year

Hope this helps

You should do two things;

1) Get a 30 year registered villa lease from her.

2) Be the villa beneficiary in her Thai Will.
Denny ********

If written properly and registered the lease is good for 30 years regardless of the owner, ie he dies or the property is sold.

Read the law.

Willism69_ Statistically, men are much more likely than women to pass away and IF the wife passes, the men typically leave the planet within five years or less. Same statistics show that women who are widows will live the same lifespan regardless of status.

Why? Because grief hits men harder than women, causing many to drink themselves to an earlier grave.

How do I know? I am a widow. My husband passed ten years ago. I am still going strong. Most men who are widowers whose wives passed around the same time as my husband are ...pushing up daisies at the cemetary!

The point being...money is the least of your worries. You'll be in a bar drowning in sorrow and it won't matter. Statistically.

I've read that in that situation you can have something like a temporary ownership (not sure the term that was used). Basically it's a temporary period that is for you to sell the property. Not sure the maximum time limit though. I'd be looking into getting some form of will or legal document made up.

Get a lawyer to make arrangements that you can live there until you die. Or sell it now.
Denny ********
Denny ********
Paddy Kan A registered 30 year lease will do that.

From the Thai Civil and Commercial Code...

Section 569 (Continuation of Lease): The death of the lessor, or the transfer of the property's ownership to heirs or third parties, does not break a valid lease. The heirs and successors must step into the shoes of the original landlord and honor the registered lease agreement until its expiration.

Another important reason to get a registered lease is it stops her from borrowing money against the property, usually to a loan shark or a bank. For they don't want to wait for your lease to expire if she fails to pay on it. Without a lease on your villa a bank or loan shark will lend money to her. And these guys or bank will boot you out faster than you can drink a beer if she doesn't pay.

Go to a lawyer and get an usufruct written up

A usufruct in Thailand (สิทธิเก็บกิน) is a legal right allowing a person (the usufructuary) to possess, use, and manage another person's property, including renting it out to derive income.

Good luck

Potpong_Life so he would be leasing it off his wife (say 30 years)? But does that contract still exist when she is dead?
Potpon******
Potpon******
Andrew Stephens yes and no

You can set the usufruct up in many ways with your lawyer

Basically it can be worded that the land is hers or the inheritance entity and the structure is his

You can also set it up to where you can stay in the domicile until you decide to depart after the owner is no longer around or your relationship is dissolved

A good lawyer will go over many details and verbiage that works the best for you

It’s a safety net in an uncertain world

I would recommend if you go this route to first get the yellow house book and pink ID card…it makes things a little bit easier

Craig **********
Craig **********
Ed Bach yes a usufruct is the way to go to insure you remain on the property however, the house is also the new land owners upon her death so in addition to the usufruct you can have a superficies on the house so that you can sell it to someone who would like to either buy the land or enter into another lease or usufruct with the new landowner…also noted is that upon her death if you have that usufruct and superficies you will in fact be heir to the land and have 6 mos to sell it or transfer it..the land office can also extend that time up to a year…
Cool_Ba********
Cool_Ba********
