Can I avoid going to Cambodia to apply for a Non-O retirement visa due to a marriage certificate issue?

Hello everyone!

I just arrived here on May 17 from the US after applying for and receiving a Non-O Marriage visa in April on the advice on Brandon Thurkettle. Thanks again Brandon! Unfortunately immigration informed me yesterday that I made a mistake by not having our US marriage license stamped at The Embassy in Los Angeles. So………it looks like we will have to go to Cambodia and apply for the Non-O retirement visa. Then wait 7-10 days to get it emailed back and start over. My question is this; is there a way around having to do that or should I just resign myself to some time in Cambodia? I have heard the agents can work around it but I also hear they do some things that the Thai government might not approve of. Or that are outright illegal. So I don’t really want to use them.

Any help would be appreciated. Thank you!

We had the same situation for not having our US marriage certificate to certified from secretary of state, US department and Thai embassy. We sent our original marriage certificate back to US and did certified. Also we use the

the US to fill the form and mail our marriage to Secretary of state and US department for us. It cost $580 (exclude certify from Thai embassy in US) and took about 2-3 weeks for documents to get done and mail back to us in Thailand. Also I took my husband to get non o spouse in Vietnam but since you already have non o from US I believe you only have to mail and certify your marriage certificate in US and wait in Thailand until you receive the document and if it doesn't get to Thailand during your 90 days for non o to stay in Thailand , you have to go apply non o outside Thailand again and come back. After you receive all documents from US then you have to go to department of consular affairs in Chaengwattana to translate in Thai and certify all documents from US again before you start open the Thai bank account. I deal with all this process in April and just done it 2 days ago. 🙂

well I’m glad to see I’m not the only one who made that mistake. I’m almost positive it was not explained when applied for the Non-O. I think rather than doing that we will just go to Cambodia (its closest) and apply for the regular retirement Non-O. Do some exploring in Cambodia 🇰🇭! Thanks for sharing that information. Been through the same thing, came in on a non O based on marriage but didn’t have the confirmation from Royal Thai Embassy so stupid me at Imm in Chom Thien: «OK, I’ll do it based on retirement then». Immigration officer: «Much easier!» so that’s what we did. Paid baht 1.000, for same day letter to the bank -opened bank a/c, baht 7 or 900 for net-bank on phone and finally baht 1.900 for year extension. This was Chom Thien, probably differs, but there is more paperwork involved in an extension based on marriage than on retirement. Might work for you also?

yeah I made a huge mistake trying to save money. I should have just done the retirement visa. I am trying to fix it now but as I’m sure you know every single person or agency gives you different information.

Go to immigration and ask them! I have found them quite helpful if you turn up properly dressed and respectful of the job they are doing. Trick is to find out who is there for «the picks» and then avoid them. A tip: the head officer who screens most applications at the information desk before passing the papers on - or refusing them - is someone you might want to avoid. Good luck!

There is no U.S. Embassy in Los Angeles, but there is a Thai Consulate in Los Angeles.

You are making this much more difficult (and probably more expensive) than it needs to be.

I prefer a retirement over a marriage visa for the simple fact you must leave Thailand the day your wife passes, or if you divorce.

Regardless, I suggest you hire a reputable, competent agent to secure the visa for you.

You can continue to use an agent (what I do) or renew yourself in the future.

If you don't want to wait in Cambodia you could exit and return on a visa exempt entry and then convert that to a retirement visa inside Thailand.

you can't do it using a web site and you can't do it if you are currently on a Non-O visa based on marriage. If you want to do it inside Thailand you need to be on either a tourist visa or a visa exempt entry (hence you have to exit and re-enter Thailand) then you go and visit the Thai immigration office that serves the area where you live in Thailand and ask them for their requirements to convert that entry to a Non-O visa based on being over 50 (retirement visa)

There are agents that can get your US marriage license legalized for Thailand. I don't know much about that process though.
