Has anyone every applied for a guardian visa? I have a half-Thai daughter who was born in Thailand and has an ID card and is I3'I've heard that she needs to be in a school for me to get the visa, we're looking at next year if possible, or is it easier to just get a retirement for myself.
Answer summary
The conversation discusses the requirements for applying for a guardian visa in Thailand for a parent of a half-Thai child. It mentions that the child needs to be enrolled in school and that merely being a Thai child is insufficient for visa approval. Alternative visa options, such as the NON-O visa based on Thai family connections or a retirement visa, are also suggested as potentially easier options for the parent.

Hi. Yes your daughter has to be enrolled in a school. I have had a parent visa for many years. Lots of paperwork needed.

Wayne Longhurst Thanks Wayne, yes I've heard about the paperwork. Do you use an agent and if so can you recommend one?

Barnaby Tricker though immigration probably wants photos of the kid in school. And of you living together.

Barnaby Tricker for a Thai, as your kid is, there's no requirements for school enrollment for your visa. Though all Thai kids have mandatory school until 9th grade. Homeschooling allowed though. But it is irrelevant to your visa.

Just having a Thai daughter is not enough for a guardian visa, she needs to be in your care. You might want to look a 90 day Non-O visa based on Thai family if you are named on the birth certificate, you would need legal rights for the extension of stay but your daughter is old enough to provide that without having to go through court as long as the mother consents. The retirement visa would be much more straightforward if you qualify

Interesting. I don't have legal custody, her mother just disappeared when she was a baby and I have proof she was in prison, might go to court to get custody as going in and and out of Thailand without that always gets me an interview with immigration but they let us leave as she uses a British passport.

Barnaby Tricker when the child is older than 7, you can go to the local district office with the child, and as long your name is on the birth certificate, the child can vouch for you to be the guardian. No mother needed. It is a bit more paperwork for that visa and yearly extension. But the financial requirements are much more lax. You would only be able to use that kind of visa/extension until the child turns 20 though.

On the other hand, if you qualify for a non o (retirement type), then that is much more straight forward and easy, plus not tied to anyone else.

I agree, you need for immigration 12 month non-o family extension, form 11 from local amphoe or court documents confirming legal guardianship, it's then only 400k in the bank. My visa is via my children using form 11 as I was never married to their mum. However for the initial non o visa outside of Thailand you can use just a birth certificate.

Thanks for that. I've looked after her all her life as her mother. Is out of the picture and we were not married. I think I: ll go with the retirement visa.
