I've currently been living in Prachinburi with My Thai girlfriend, now fiancée for about 7 years, extending My Non- OA retirement visa each year. As I have adequate health insurance from My retirement in the USA and renewing My Thai policy every year for My Non-OA extension is becoming costly, I'm considering changing My Non-OA to a Non-O so I can stop having to purchase the Thai policy every year. I already have Thai bank accounts and maintain the required balances. Are there any disadvantages in changing to a Non-O I need to know about?
Answer summary
The user is considering switching from a Non-OA retirement visa to a Non-O visa to avoid purchasing an expensive Thai health insurance policy. They currently have the required funds in their Thai bank accounts and have been living with their Thai fiancée for seven years. Comments suggest that changing to a Non-O visa would mean they need to exit Thailand without a re-entry permit, but might offer benefits such as not needing local health insurance and easier renewal processes due to their relationship status. However, it could require more paperwork and navigating different immigration rules depending on the office.

You can definitely change the "reason" of a 1-year extension which you got out of a Non-Imm-O Retirement Visa, the very moment you have 30 days left on your extension and are about to apply for the next 1-year extension, from "retirement" to "marriage with a Thai wife".

You can also change the "reason" vice-versa - from marriage to retirement.

You can do this as long as you fulfill the financial requirements and those document-wise.

However, you cannot change the "reason" of a 1-year extension you got out of a Non-O/A visa, to another "reason" that can only be obtained based on a Non-O visa type.

From "O" to "O", yes, you can.

From "OA" to "O", no, you can’t.

In order to be able to apply for a Non-O Visa, you first need to invalidate the stay permit you got stamped out of the Non-O/A Visa. You cannot do a “reason change” even if you are already on a 1-year extension of stay.

with the marriage visa you don't currently need insurance, which I fine as I pay as I go, last year with kidney and gall bladder stones did about 7 hospital visits, plus MRI scans ,Xray's and whatever they suggested . All up plus 2 nights at private hospital 18,000 baht then the 2 night in local hospital private room 3,000 baht. So costs not to bad. Then with marriage visa you can also apply for a work permit if you so want plus money in bank is 400,000 baht or letter from embassy showing income from source back in old country. Apart from that when you apply for extension there are a few hoops to jump but when sorted pretty easy. Where di you get married, Thailand makes it easier for the local Amphur to issue letter stating yes you are married and your passport is correct. My wife and I got married in NZ 20 years ago had the marriage cert translated but Amphur were not interested said wife still single in Thailand. So we had a company in Bangkok go to embassy for my NZ passport translated marriage cert, went to Thai Internal affairs got the paperwork certified to show , yes we are married, think it cost about 3,000 baht all up . then back to the local Amphur all happy letter issued says we are married for Immigration extension. Also for our first extension Immigration visited our home had something to eat talked to our 2 witnesses, lucky 1 was village 2ic so knew what questions Immigration were asking about us. So lived here 5 years no problems with Immigration do 90 day reports in person as day out in the big smoke.

You might want to check with Tod Daniels (one of the moderators on this site) but if you extend you OA visa as married then you may not need health insurance.

Marty Pollard you cannot "extend you OA visa as married". There is nothing such. Before he can apply for the 90-days Non-Imm-O Marriage Visa, he needs to invalidate his O/A Stay Permit.

Greg Alexander I had an OA for 6 years. I’m not sure about that. Tod knows.

If you're going to marry your fiance and in the end want a marriage visa you'd rather have a O Visa anyway

The Non-Imm-O Retirement Visa and the subsequent one-year extension of the staypermit based on retirement, has no disadvantages. It actually has the advantage that you are free from a mandatory Thai health insurance. You have freedom of choice to contract an international health insurance, or use your U.S. ss-benefits or self insure

You have two options, and both of them need you to exit Thailand without a re-entry permit, because this is the only way to invalidate your O/A stay permit.

***Option ONE is applying for the 90-days Non-Imm-O Retirement Visa outside of Thailand, re-enter and get stamped in for 90 days, and up from 30 days before the 90 days are up, use the bank letter that confirms the 2-months seasoning of 800,000 THB to apply for the 1-year extension of the stay permit based on retirement.

*** EASIEST is Option TWO: it means re-entering Thailand visa-exempt, you get stamped in for 60 days, and visit Immigration to apply for the "change of visa type" from the visa-exempt entry to the initial 90-days Non-O visa.

For this application, you need to show that you already have a minimum of 800,000 THB sitting in your Thai bank account, and you need a proof that the money came from abroad.

And you will - at least on most Immigrations - need a rental contract.

Check the requirements under number 9 of this list on the Immigrations’s website regarding the “change of visa type”.

Visit your Immigration before you make the move, make sure they are accepting applications for the “change” and make sure you meet THEIR specific requirements for the “change”.

None o marrige visa is what I'm going to apply for.

My Thai wife and I are presently living in UK.

We are leaving this year to retire in Udon Thani

My monthly income will allow for not having the 400,000 baht tied up.

Go for it.

John N Kwan on MOST Immigration offices, you cannot use the 12-months of transfer method for the application to the 1-year extension based on being married to a Thai wife. You can only use the income method if you either legally work in Thailand and receive the minimum wage, or can show an income affidavit of your embassy, or showing the 400,000 THB deposit

John N Kwan Its Thailand, You can never be completely sure of anything. Always remain flexible and prepared for all contingencies. Especially where Thai immigration is concerned.

Will Den Be careful as every immigration office interprets the requirements differently, even the same office can have a different requirement depending on what day it is and who's working that day. Even though the rules clearly say a certain amount in the bank OR a certain monthly income, OR a combination equal to a certain amount, I have experienced more than once where the immigration office wanted both, a certain amount in the bank, AND a certain monthly income. And don't bother arguing or pointing out what is clearly written, they want what they want. Always check with the local immigration office where you'll be living to make sure you can meet THEIR requirements.

Will Den the UK Embassy won’t certify pension income which Thai Immigration require. Might be worth you double checking with Udon Thani Immigration what they require and will accept. IIiRC you also have to apply for the first extension based on money in the bank not monthly income. I’m sure others on here will tell you better. But remember every Immigration office varies.

Other than you need to leave Thailand without a re-entry permit and should apply for the 90 day Non-O wherever you travel to before returning I can't see any downside

OK, again thank you to everyone for the information. Changing appears to be more trouble than its worth for now. I'll just continue renew My Non-OA extension like I've been doing. Keeping the 800K in the bank isn't a big deal, if it wasn't sitting in My Thai bank it would just be sitting in My USA bank and it makes interest either way. My only concern for changing in the first place was being able to drop My Thai medical insurance policy which I don't really need. But it doesn't hurt to have the extra coverage so for now anyway I'll just leave things as they are. Appreciate the information though, now I know what is required if I decide to make a change down the road.

Before you can apply for the 90-days Non-Imm-O Marriage Visa, you need to invalidate the O/A Stay Permit by exiting Thailand without a re-entry permit, or if you bought a multi re-entry for it, you need to wait outside of Thailand for the Extension to expire, before you are free to apply for another visa, or do the "change of visa type" inside Thailand

Stephen Howell Thanks guys, I live outside Prachinburi and use the immigration office there, its small and they know Me. They're very easy to work with even if they do sometimes want more than the basic requirements. As My fiancée and I aren't married yet even though we've been together for 8 years I can't change to a Non-O marriage visa yet anyway. I was just wondering if I could change from the Non-OA to a Non-O to drop the Thai insurance. I appreciate all the information and now definitely know what I can and can not do based on My personal situation.

Stephen Howell In My case I don't transfer 65K every month. I maintain one account with the 800K in it and have a second account I actually live from and transfer money into as needed. When I go to My local immigration office and they sometimes want both I always take My 800K bank book and statement, and My second account statements and My pension income statement that shows i receive more than 65K monthly income. They're happy with that. I know the rules clearly say either 800K OR 65K but immigration wants what they want and I learned long ago to just go with whatever they want.

If you've got 12 months unbroken 65k transfers obtained on the OA, it is accepted. At least, in Bangkok it is, I can't speak for other immigration offices!

as long as he applies for the 90 day Non-O outside of Thailand, 65k method is not acceptable for a Non-O inside Thailand

Nongnuch Kamdee **if he's been smart enough** is the qualifying factor of my statement. Many people go this route via OA to avoid the 800k lump sum

Stephen Howell well, he wrote " I already have Thai bank accounts and maintain the required balances" So I presume he does not do the 12-months transfer proof and can prove the 800,000 THB in one of his accounts

Nongnuch Kamdee Actually if he's been smart enough to already be on the 65k monthly transfer method, he can continue this and not have to worry about the 800k. That's what I did
