Dear all, good night.

I’m 51 years old, live in Bangkok since 2015 married with Thai wife since 2013. Despite we still married we are separated now, therefore not expecting to renew my visa Thai-wife expire in Jan 2027. I have enough experience in Thailand, but never applied for retirement Visa Non O A.

Any recommendations to change my Visa ?

Thank you in advance guys
Answer summary
The user, an expat living in Bangkok since 2015 and married to a Thai woman, is seeking advice on changing their visa status due to a separation. As their marriage-based visa will not be renewable without their spouse present, the comments provide various suggestions. Most agree on applying for a Non-O retirement visa, which requires proof of having 800,000 baht in a Thai bank account for at least two months. Some commenters mention that it could be easier to get divorced first to avoid needing the spouse's presence at the visa change. Additional points include the importance of checking with local immigration offices as procedures can vary, and considerations about parental rights if there are children involved.

I went from marriage to retirement but I'm still married. Had to show my marriage certificate. I don't know why. If you still have a current one might be easier not to tell them you are divorced.Or go ask them beforehand what you need.

Bank in 800k to your acct and do your extension base on retirement (above 50yrs old) if the immigration does not allow the switch den travel out of thailand and come in on a visa exempt.....apply for a 90days nonO retirement inside thailand (800k) in bank acct....do your extension yearly thereafter....im married to a thai but i use the retirement route.....there's no law that states that you can't use that route when u are married to a thai....the downside is you can't work in thailand base on that route

You are on an extension of stay based on marriage. You can change the reason for the extension from marriage to retirement. At the moment I assume you do the extension yourself and have 400k depositited in a Thai bank. For retirement you need 800k.

One thought would be to get divorced then you wouldn't need your wife to be present. The day you get divorced you could cancel your extension of stay based on marriage and immediately apply for the extension of stay based on being over 50 by meeting the requirements. But if you work in Thailand you will no longer be able to do so on that extension.

the only problem is with two kids and likely associated assets, all that needs to be defined in the divorce paperwork adding a fair amount of complication to the process - unless OP and wife agreed to sign a 'no claims' waiver as we did and divide assets privately later.

It's been 4 years but I went in and did the change of reason to retirement, meeting the criteria and got divorced later. That made it very low stress. That was at a time when there weren't so many wrenches thrown into the works I guess.

There is a YouTuber from Tak who got divorced. He used his separation time to find himself a “next”. Similar situation, has a child although she is adult now. Amicable with ex which I think is important for all purposes. Good luck.

Yep, thanks for your support guys. I know the policy of the 800K thb. The only doubt would be if my wife will come with me last time or not. Moreover, I got 2 Thai-Ita daughters in Bkk 18 and 12. Tried last year get visa extension with them in Government Complex Chaeng Wattana, rejected because I still married so need my wife be there with us.

However, since you have a child, there may still be options for you to stay legally in Thailand based on being the parent of a Thai child.

* Non-Immigrant O visa based on supporting a Thai child

* Usually possible if:

* The child is Thai

* You are the legal father (your name on birth certificate)

* The child is under 20

* You can show involvement/support in the child’s life

Yes. Last year i tried with no success cause I still married.

I could do it only if legally divorced

I may not be up to date on this but I went ahead and changed my reason for extension to retired from marriage and it was done as smooth as silk. This was in a different province it seems like are the problem may be the office you're dealing with, perhaps an agent could help you, but all I really know about them is what I read in these groups.

A few months later we went for a divorce by agreement.

I've read many times on this forum that you need both a police clearance and insurance from one of the designated insureres for a Non-OA visa. May be easier to apply for a simple Non-O based on being >50 yo.

Jorge Jo The OP could not get a Non-OA without returning to his home countr

You're not on any visa right now, you're on an extension of stay based on marriage to a Thai.

Since one of the requirements for applying for the extension is having your wife present, it sounds like you won't be able to apply based on that come January.

You're not going to change any visa (because you're not on a visa). Instead for your next extension you'll simply apply for the extension based on retirement (age 50+) instead of marriage.

For this you'll be required to show proof of 800,000 baht in your Thai bank account that has been there for at least 2 full months at the time you apply for the extension.

The only issue you might have is that most immigration offices require your spouse to be present to make this change. You might want to go to the immigration office within the next few months to ask if they'll allow you to change the reason for your extension without your wife being present, or make an arrangement with your wife to be present for this final extension if possible.

If it turns out to not be possible, it means you'll need to leave Thailand and reset your status completely. You can then apply for a new non-O visa based on being over 50 at a Thai embassy wherever you travel to, or return as a tourist and apply to convert to a non-O visa from your immigration office (if they allow such conversions).

Hans Boersma which country are you from? I’m from the U.S. and it’s my understanding U.S. folks are saying they can’t get that proof of income document. Not sure if this is true hence my inquiry

You atre on an extention of stay based on marriage not a visa so when you next apply for an extension you apply based on being over 50 and by meeting the requirements (i.e. 800k)
