How to handle ฿800k deposit for Non-O visa

Please only responded if you’ve done the following. Share your experience of costs and procedures. Question on your ฿800k deposit for the Non-O visa:

Since Thai banks do not do PODs (Payable On Death) as done in the U.S., and the Thai method requires having a Thai will drawn up and having an administrator chosen or appointed, what did you do?

The Thai process smacks of US midwestern states who require attorneys to get involved, essentially creating a probate structure.

I’m wanting to find the cleanest way to keep undeserving hands out of money left for my heirs. I’d like to choose an administrator of my choice.

Also, I’m assuming each bank has their own processes to release money after the death of a depositor.
Answer summary
When dealing with the ฿800k deposit for a Non-O visa in Thailand, it is essential to understand the local laws regarding wills and inheritance. Unlike the U.S., where Payable On Death (POD) designations are common, Thai law requires a will lodged at an Amphoe (district office) and may involve appointing a local administrator. Participants in the discussion shared experiences indicating that having a Thai will with a designated executor is crucial to avoid complications after death. Many emphasized the importance of consulting with a competent Thai lawyer to draft the will correctly. Costs related to establishing a will can vary but generally include court fees and translation costs. Comments also highlighted the need for a clear list of assets and the potential for complications if proper legal steps are not taken.

Thai will lodged at Amphoe will require a translator. Private will can be simple bilingual document if it's just for the bank account and can be witnessed at your embasy. If your benificiary resides outside Thailand it may be cheaper to use a legal firm to lodge court documents rather than have them fly in. Australia legal will for bank accounts which if over $10,000AUD rerquires probate and have a binding death nomination for my Superanuation. Partner can't be involved in the paperwork but can provide transport. If you go down the DIY route make sure your benificiary has a signed copy of your Thai will. Budget 2000Baht court fees and at least 1000Baht for any documents that need translation. Uncontested will would have low legal fees if it's lodged by a Thai speaking legal representitive.

Should be cheap and easy then if you can speak Thai the Amphoe is a cheap and indipendant option.

Thai law applies in Thailand and USA law applies in USA so if you don't want to be 'restricted' by Thai law then maybe don't live in Thailand. If you want to live in Thailand then forget about laws in USA, UK, Australia or whatever country you came from are and just accept you are now living in Thailand.

it's a long time since I and my husband did our Thai wills, so can't remember the fee. My husband died last year, and I was named sole beneficiary and executor of his assets. I went to court with everything prepared by a lawyer (100,000 baht), and was granted adminstrator; took the relevant papers to his Thai bank and they transferred the money across to my account there and then. It took about 3-4 months (compare this with Hong Kong - supposedly a super-efficient financial centre - where my appointment for probate isn't until March 2027!).

Doing my Thai ( WILL ) now, this is the information from my Lawyer…

2. Current residential address.

3. Date and place where you wish to sign the Last Will. For example: Bangkok on 20 June 2026.

4. Name of your executor. Any trusted adult may serve as executor, commonly a relative or close friend. Heirs may also act as executors if aged 20 or older. Since you mentioned you have no spouse or children, you can appoint a friend, or our company can be named as executor if you have no suitable person in Thailand.

5. Details of your main heir or heirs. For foreigners, a passport copy is sufficient.

6. A clear list of assets in Thailand. This includes bank accounts, vehicles such as cars or motorcycles, and other valuables. You may also simply say: I give everything to [Name] and that is legal. However, we suggest listing important assets.

7. Any additional wishes you would like included, such as funeral arrangements.

A Thai Last Will does not require notarization and does not require registration at the amphur. Signing takes place in front of two qualified witnesses who are not heirs and who are at least 20 years old.

Hope that helps. 👌🏾

Just add whoever you want on your bank account but you limit the use. This is very easy. My wife is listed on my account but has now book or card and cant access the account without me - in the event of my death all she has to do is take the Death cert to the bank and she gets full access.

Your assumptions are mostly wrong.

Under U.S. laws you can designate a PoD or ToD beneficiary at any bank, not just those outside the “midwestern states”. Also, in the U.S. you can choose a bank based in any state and bank online. Not sure why you assume midwestern banks don’t have pod/tod.

Second, the way to handle this in Thailand is to have an experienced, competent Thai lawyer draft a will.

If you don’t have a Thai will with a designated executor and set of instructions, the Thai laws will appoint an executor for you and follow a standard set of instructions regarding beneficiaries.

It’s not difficult really. But, you do need to have a will on every jurisdiction. where within you maintain substantial assets, and the will should be limited to those areas and mention each other.
Gregory ********
Gregory ********
OP
Brook Powers that’s not what I said. You can do a POD at any U.S. bank. I said you cannot do at Thai banks.

My comments about midwestern states-not banks-was about laws in those states that require more than a will or a self appointed administrator, which is a way to keep money flowing through the system. It’s done in escrow for real estate as well.

My statement was “Thai process smacks of midwestern states” nothing to do with PODs.

Of course, I’ll go to a Thai attorney. I’m getting some people’s experiences so I’ll know what’s up before I go and know if what they’re feeding me is honest. 😉

I made a Thai Will with my wife as the administrator and I have an Australian Will with my son as the administrator. All fixed and I don't use the 800k in the bank, I use the monthly deposits. Still run about 600k in my account just in case it's needed. The Thai will a Superficies for the house was $1,500AUD 5 years ago. I think you should be asking a Thai lawyer the best way. Brian Ramsden can help.

A will is about 5k in Thailand. The beneficiary can be the administrator or anyone you choose. Death cert goes to court and fund will be released.

Banks dont like to release funds and can be difficult but that's the process.

The Thai law does not have a POD and the US law doesn’t count in Thailand.

When somebody dies you have go to court with the death certificate and they will authorise the release of the funds to the beneficiary.

I did this 3 months ago when a friend died.

It's a good question, one I hadn't considered. In the US you can designate a beneficiary on all financial accounts, those pay-off before any probate or non-probate payouts.

As for Thai law, it would only apply to how the Thai banks handle these requests from your estate administrator. There has to be a process.

Now I have another thing to check into ;)
John **********
John **********
@Shawn *******
the process is the executor you appoint has to apply to a Thai court to be officially recognised as the administrator of your finances, like probate. The bank won't release funds without this

Shawn Sheely Thai govt and banks want to be involved.

It’d be a shame for someone to need probate in the U.S. with all that’s known about protective financial instruments available.
Shawn ********
Shawn ********
Sorry, what is POD? Are you talking about a US type benefactor?

The best way to avoid probate is a detailed and up-to-date will, and file it in the US (which I've done). Your US will takes precedent over Thai law, with exceptions for a Thai spouse. That does make it more complicated, but I did a prenup as well.

It looks like your primary question is how would an administrator request the funds to be released to the estate they are managing. I think that's a question for an attorney versed in the two countries laws.

Either way, get your will complete and if possible notarized and filed at your home courthouse. That clears the way for your administrator and avoids probate, gives them accounts and institutions to begin the process.
Wannikea *********

Shawn Sheely a US will to cover US assets, a Thai will to cover Thai assets.
Gregory ********
Gregory ********
OP
Shawn Sheely POD is Payable on Death

Is this what you’ve done? My understanding is US will or trust does not supersede Thai law. I have a trust. I only need to know about what people are doing on the Thai side.
