Hello I would like to ask if I can apply for a retirement visa while I am in Thailand before the 31st of July. I entered on a 60 day tourist visa. I am hear now on amnesty. I have a bank account with the required funds. So are immigration offices giving out the retirement visas before the 31st of July. Or do I have to leave then come back to apply?

Thanks ๐Ÿ™

TLDR : Answer Summary
The original poster is inquiring about the possibility of applying for a retirement visa (often referred to as a NON-O or NON-OA visa) while currently in Thailand on a 60-day tourist visa and under amnesty. Responses indicate that applying for retirement-related visas is generally not permitted from within Thailand if one is on a tourist visa, as they often require leaving the country to initiate the application. However, some agents may offer services to apply without departing, although this carries risks, especially with the reality of scams and potential legal repercussions if caught. It is recommended to consult local immigration offices for specific guidance and requirements.

If you got the cash loads of agents can do it for you without leaving the country there is a special circumstance right now for changing you can get retirement marriage or volunteer without leaving
Jennifer ********
I didnโ€™t say I was doing it but Iโ€™m just saying itโ€™s available ...

@Jennifer *******
. EVERYTHING is available in Thailand, if you have the money and are prepared to take the fall when things go wrong!

@Jennifer *******
there are too many scams. One offered me to do it to help stamp in another year. When I asked if it was legal he said " are you the police?" He wanted 75 thousand bht. Be careful because of you are caught with an illegal stamp you go to jail
Greg ********
@Bim ******
75k is an outrageous price. The going rate for an O 90 extension plus 12 retirement extension without money on the bank yourself is 25k +- 1000
Bim *******
@Greg *******
rip off scam artist who troll these forum looking for victims. And the more desperate you are the higher the price.
Greg ********
@Bim ******
Yup scum looking for people in distress or desperate.
Bobby ********
@Jennifer *******
. You are aware of the repercussions of being involved in illegal visa scams? It ain't pretty!

the government are doing it for you itโ€™s all legal through the immigration office

. If you're paying

baht to an agent it's not legal. It's all good if you're not caught. If you are it's goodbye Thailand.

There are illegal ways of bending rules ie someone depositing the money overnight to get letter from bank manager or even nothing shown st all. However, some people use agents just to save time and for convenience. I have done it as I coukd not be arsed going to the office and sitting in queues. I work for a BOI company who has been BOI for over 45 years. We have over 10k employees here and hundreds of millions USD invested. Agents are used to put all the paperwork together and process. It just saves time and we do not have to employ staff to do it. C-Suite, VPs, Directors and specialists time is worth more than cost of an agent ๐Ÿ˜‰๐Ÿ˜‡. You do have to turn up once to stand there for a minute while they check you against the pics supplied and passport photo. Ypu may sign somethong but most papers are put in front of you with stickers where to sign. ๐Ÿ˜Š

@Greg *******
. Totally agree. You can tell from the price if it's a legal process or not. Although I've not used an agent (actually I use an unofficial one, my partner, who works in an administrative job in Bangkok, so is well-versed in bureaucratic documentation - every time I return from overseas she has all the TM30 paperwork ready to go, I just have to sign in the space provided!), but I do realise they can save you a lot of footwork for a reasonable price. The "funds in your bank account" is the worrying one! My 80 year old cousin in Chiang Mai used an agent in this way for seven years, until he got a visit from immigration with a request to see his bank book mid-stream, which had about 5000 baht in it. He was arrested and taken immediately to a detention centre where he waited for a week while his deportation was arranged and a "never to return" label put on his file. He was not even allowed to return to his condo to get his belongings, he had to organise all that through friends to get his stuff sent on. I just have concerns with some of the things these agents are offering at the moment at inflated prices. From reports we know the only visas that can be obtained from amnesty are Thai Elite and ED for a university degree, so when you hear of non-O visas being offered for tens of thousands of baht, my immediate reaction is "shonky!!"

Agree about some of the agents. I do know of guys using agent witout money in bank initially but then getting extensions on their own whrn they have the funds documented. You are not always tied in forever bit of course it depends on agent and office. On our BOI visa we have never had to do 90 day reporting or TM30. I think reporting might be once a uear but if you travel it starts again like a normal 90 day one. No idea I have someome to deal with that. Same with medical claims, drivers arranged etc. After a couple ofcyears retired and doing it myself I forgot how easy expat life could be at a large company ๐Ÿ˜‰๐Ÿ˜‡๐Ÿ˜
Bobby ********
Go ask the immigration office where you are staying what their requirements are.
Bim *******
@Bobby *******
very good advice. Some have there own way of doing things.
Bobby ********
@Bim ******
. They ALL have different ways of doing things!
Bim *******
@Bobby *******
so very true. We are very lucky to have a great immigration office here. Then you read the experience of others and it's so different to what I myself experience.
Bim *******
I was told my immigration two days ago they do not issue within the country a Non O unless your on a 30 day exempt. I have been here 7 years and been told I have to leave on 31st July to get the 30 day. An impossible situation. OA can only be done in your home country
Greg ********
Pre-COVID I was on a visa exempt. I used an agent to convert this to a Non-O 90 day and then a 1 year O based on retirement or whatever they call it. I never left the country. It may be different now with COVID and amnesty etc. Cancelling the visa so i could get a Non-B to work agan was 10 times harder than getting it in first place
Andy ********
@Greg *******
Your agent must have given them a good back hander as I was told by everyone at immigration that to change to a non-O 90 day you needed ar least 30 days remaining. Did you get an extension to your visa exemption giving more than 30 days and have to show funds in bank etc???
Greg ********
@Andy *******
I may have extended, just cannot remember, and yes I had enough money.
Bim *******
@Andy *******
it's perfectly legal. When you apply on a 30 day immigration issue a processing stamp while your application is being considered. You don't need 30 days left but you do need to do ASAP. And you don't need an agent
Bobby ********
@Bim ******
. Depending on your immigration office you need either 14 or 21 days remaining on your last entry stamp, as the application goes "under consideration". My advice is the OP should attend his local immigration office and request the list of requirements required for obtaining a Non-immigration O visa. The office will be issuing the visa so what they say goes. You will get a dozen different versions from asking the question in a Facebook group.

@Bobby *******
good advice

@Bim ******
I used agent as I am a lazy bugger and like an easy life.

There's no such thing as a "retirement visa". Assuming you're over 50, I think I'm right in saying that What you need has to be applied for in your home country (or a country where you have official residency). For example NON O or NON OA. Extensions of stay based on retirement can be applied for in-country (stringent requirements must be fulfilled).
Nick ************
You apply for a non oa Visa and show a sufficient bank balance that does not have to be in a Thai account. At renewal you change to retirement Visa at which time sufficient funds must be in a Thai bank account.

@Steve ********
So you cannot get a retirement visa for over 50 years of age.
Andy ********
@Done ******
If you are over 50 you can apply for a Visa based on the fact you are over 50 but need 30 days minimum on your current Visa. As you are here in the Covid-19 amnesty you cannot apply and will have to leave and apply from outside if Thailand or come back at a later date on a Visa (not Visa exemption stamp) and change then. Either way you cant do it in your position now.
Jennifer ********
@Andy *******
they have an exemption to that right now you pay14,000 baht and you donโ€™t need to leave the country
Andy ********
@Jennifer *******
really, I've never seen that anywhere but after I changed over myself from a 6 month Visa stopped looking to be honest.
Stan *******
@Jennifer *******
Do you have a source for that please?
Jennifer ********
@Stan ******
loads of agents ... I have been told by a few of them .. can pm you them if your interested
Stan *******
@Jennifer *******
I know a few agents, but only for those who they charge 14,000 if they don't have sufficient funds for their extension
Bob **********
@Stan ******
14,000 won't get you the non-o and the one year extension it'll cost 25,000

And up
Stan *******
@Bob *********
I didnโ€™t say it would. Itโ€™s what someone without the necessary funding has to pay to get an extension on an existing retirement.

The initial retirement is a totally different matter
Bob **********
@Stan ******
yes correct
Jennifer ********
@Stan ******
Iโ€™m not looking for retirement visa for Ed visa they can change or volunteer visa
Stan *******
@Jennifer *******
Nor am I, I have one already.
