Hello! A friend of mine is an owner of a Thai company that employs online teachers. His Thai lawyer told him that he could legally employ foreigners who hold work permits with other companies. That is not what I've heard. Any comments, please? Thanks...

TLDR : Answer Summary
The discussion pertains to the legality of a Thai company employing foreigners who hold work permits from other companies. Most comments suggest that work permits are specific to one employer and location. While there are exceptions that allow for multiple work permits under certain conditions (such as obtaining a No Objection Certificate from the primary employer), the general consensus is against operating under a work permit from another company without proper authorization. Conflicting perspectives highlight the need for clarity from legal professionals or relevant authorities.

Wouldn't trust agencies within a 10 mile radius. Just like I can't be bothered with them in England. Money making leaches

I have a wp through the wife's business. I got offered a job part time and went to dept of Labour and they told me it was possible to do both. Hand the wp in and get a new one with two jobs listed.
Charlie *********
Actually the international job fell through for seperate reasons, but yeah the lady who issues the wps said it was not going to be a problem as both jobs qualified.
Paul *********
Interesting - . . .

So you have multiple jobs with multiple companies / employers listed in one work permit document.
Charlie *********
No. One is my wife's company, the other an international school

Same employer / company ?

This is one of the new fines on the labor law: Foreigners who engage in work different to that which is registered in their work permit will be fined up to 100,000 THB.

@Robert ******
yup. I’m mean ministry of labor and immigration.
Robert *******
As far as I know, Immigration does things with Admitted to Stay, Extension of Stay and Visa. Nothing to do with Work Permits, I guess you mean the Ministry of Labor. And yes I know that you can have multiple employers in the Work Permit.
Jimmy ***********
Go and check with immigration. You can have a 2nd part time work permit if the first company allows u to work.
Marc *******
Work permits are for a specific work at a specific location.

Ask the hot shot lawyer to put it in writing and that he will assume full responsibility ...and watch him run.
Jimmy ***********
Yes, he can. I had 2 work permits Nan province. My school Gave an authority letter to the second company and immigration and I was able to have to work permits at the same time one from my school and one from a learning Centre
Jimmy ***********
@Lloyd *******
u need an approval letter from the current full time employer and by the way ur second employer will not me mentioned on your 1st work permit. You will be issued 2nd new work permit. I have worked 5 years with 2 permits till November 2016 and just had a discussion with my friend who works at Nan immigration too. The best thing is let this guy go meet ministry of labor to sort his issue.
Lloyd ********
No need for a letter if you get a second work permit, only if you add an employer to an existing permit.

Is it considered illegally working if your business is online, but staying in Thailand on Tourist visa? How can you get a work permit if you just make your income on Paypal?
Jason ******
@Robert ******
I'm not eligible for that because I'm not officially married yet with documentation from the amphur. thats my future plans it will be better when I don't travel as often, because I will only need to leave once per year, but since this past year I've been traveling every 90 days to other countries (Laos, Malaysia, Hong Kong) I just applied for the tourist visa before coming back, and recently got a new 52 page passport so I plan to go to Vientiane again next year when I need to renew my Visa
Robert *******
@Lopez ****
You may call your tourist Visa a Non Immigrant O visa based on marriage with yearly extensions. I understand after being member on this site for longer time. What's in the name after all.

@Robert ******
The first year I was here I entered only on Visa exemptions until I decided to stay long term after moving in with my Thai partner. Thats when I started to get Tourist visas for the 90 days and travel out of Thailand every 3 months. This is when I'll go to Vientiane, or Hong Kong, Singapore, and when I come back I'll have a new Visa. The officers can see my history everytime they look at my passport and see this and only asked me why I'm staying in Thailand which I explained my reason. They didn't get angry at me or say what I am doing is wrong. The main rule is employment prohibited. So as long as I'm not working and traveling, that's a good thing in their eyes.
Robert ********
Lopez, I just hope you don't do something which you might later regret :-)

Always good to have your girlfriend as your wife or a wife as girlfriend. 😉

Robert A. Piccus I never said I am working. 🤔 I am asking to confirm that it is illegal. I actually follow lots of people on social media, who claims to have spontaneously moved to Thailand, that are from US, and constantly posts photos of them with captions saying "working from my home office (hotel)", which has them being on a laptop. So I am assuming they receive income through Paypal or some other internet option and was asking because I'm curious if what they're doing is illegal. Don't assume and point fingers at me and accuse me of working illegally just because I asked the question. The only reason I am living in Thailand is because of my girlfriend. There's no point in me paying $15,000 for a Thai elite Visa when I will be eligible for a Non Imm Visa based on Marriage with a yearly extension. Also Thai Elite Visa is VIP treatment where they pick you up with a Limo and have your own Lounge at the airport. I don't need that. I'm a Tourist, based in Bangkok, because accomodation is $300 per month. where as US is $1,500 per month. I can spend all that extra money saved traveling every 3 months instead.
Robert ********
He said he was aware of the Thai Elite Visa but will not consider spending such funds until such time as he can no longer remain here on repeated tourists visas.
Robert *******
He is allowed to stay long term, there is a Thai Elite Visa based on the tourist Visa for 5 and 10 years.
Robert ********
I remember Lopez commented in an earlier string about foreigners should be allowed to stay in Thailand long term while on tourist visas. Then he claimed to have significant savings and did not need to work. It seems that has changed.
Robert *******
Digital nomads, you must love them. I get paid on paypal. So I can work in a foreign country as a tourist after I signed I shall not engage in any profession or occupation. Keep on working and if Police or Immigration comes to get you, just make sure to collect enough from your paypal account.
Robert ********
You should not be working in Thailand while on a tourist visa. Pretty much common sense!

Yes, you would have to get a business visa and work permit, I would say
Robert *******
This was on your Visa application form and you signed it: "I hereby declare that the purpose of my visit to thailand is for pleasure or transit only and that in no case shall I engage myself in any profession or occupation while in the country. " I would advice to read better before signing a paper.

If the primary Employer agrees and the issues the NOC and then you go to DOL with that the "second job" can be updated on the WP. So ppl having WP issued by A ( primary employer ) can also work for B , if A has no objection and issues the NOC.

Aha! There we go! Thanks...
Robert *******
As long as the employee is doing the job as described in the WP, at location set in WP for the Employer named in WP there is no problem.
David ****************
Agree
David ****************
It’s wrong as the work permit stipulates where your working and the job you do there. If that wasn’t so, why do teachers have to change WP’s when they change schools?
Dan ********
It carries the name of the company that employs that person
Robert *******
The WP carries the name and picture of the individual and not the school. So I guess also based on that the individual has to sign for the work permit to collect it, it is his, not from employer.
Dan ********
Because the workpermit belongs to the school not the individual

As a freelance diving instructor/consultant i can work for any dive shop in the provence my company is registered. If i want to work in a different province i need to add a new branch in to my company and work permit.
Paul *********
I would have to say no.

You can't ride on another companies work permit.
Robert ********
Work permits are employer specific, some people ignore the fact and work in other companies. But they are not supposed to.
Bennie *******

the wp is bind to one company and place of work. you can add additional places and companies - but just with the wp from someone else - cant work for him

Just count how many conflicting answers you will see in this post. Unless it’s Tod, Lloyd or Robert it’s mostly hearsay.
