What should I consider regarding property ownership and visa options in Thailand after purchasing land with my Thai wife?

Visited 8 times. Just purchased land with national Thai wife.

Now , to figure out the next things to do regarding visa, driving, building house and so much more I don’t even know about. I would like to spend part of the year in Thailand ,during the best months , and part of the year in USA.

11 years ago my now wife built a house on land provided by her father.. I supplied the money for our 127 m2 3 bed, 3 bath house in Udon. She did an amazing job..The house and land is all in her name. If I ever were to lose this, pffft, I don't care one iota. The main thing is love and trust, and we have that in spades. People will tell you, contract this and contract that, keep separate accounts, don't trust her, blah, blah, blah. If you love her and she loves you, just go for it. Look forward and not back. Trust her, trust yourself.

1.Make sure your marriage is registered and recorded. A Bhudist ceremony doesn't count in court.

2. Your wife needs a will designating her wishes upon her death. Just as good as a Usufruct in court. Again registered and recorded.

IF she should pass before you a few thousand baht for attorney and court costs enforce her wishes.

The land was sold in lots by a company not owned by family. Others bought lots. She pays for land. I will look into the suggestions of joint ownership. There are about 15 lots next to each other. She was able to buy three . Two attached and another very close . I will copy everyone’s advise and refer back to it. Thank you.

Good luck and God bless. I think you’ll be fine. Trust your heart and most importantly , trust your wife. There are many foreigners that have been married to Thai women and have been for many years.

I was married to a Korean woman for over 30 years. She passed away a few years ago. Now I have a Thai wife. I trust her and have no qualms. God has a plan for each of us. I like your plan of living in the States and going back and forth to Thailand. That’s what we do. I make serious money in the States that I could never make in Asia. Live the dream.

2079.html Norway has issued wartime requisition notices to 13,500 civilians warning that vehicles, land, buildings and equipment can be taken for defence….with compensation later.

It could easily also happen in Thailand. It’s scary cos Thailand doesn’t even recognize a common law jurisdiction, and it does not recognise the separation between legal ownership and beneficial ownership in the way that the UK, Ireland, Australia, or the United States do. Please DYOR.

Its a great idea and I am.in the same situation except my wife already owned a lot of island land before I married her. The main issue is, spending part year in two countries means you have to buy 2 of everything and maintain 2 dwellings nit being able to really rent either of them out.

Make sure you get a long lease on the house to stay there for the rest of your life,also get an agreement preventing her borrowing money against the house or land,without this if you separated you can continue living there or an agreement saying you own 49% of the house.

If your wife dies it could be left to her family and they could kick you out ,no matter how well you get on with them get it legal on paper

I would not be at all surprised if you have just paid for land that already belonged to her or a close member of her family. It is still theirs. I've seen it happen many times. The land should be at least 300 km away from any close member of her family and preferably nowhere in Issan.

Just remember all the money you spending is non returnable, so do not borrow or loan it, it gifted ,make sure you have a fall back plan,and money if it go sideways,remember you are a guest in Thailand,, now after all that ,you must be happy in your mind what you are doing ok

Slow down, you are doing too much at once.

I’m not rendering legal advice, but sharing what I know.

1st - I assume you bought the land for her. (You own nothing and will be happy - maybe happy)

2nd - Prepare a 30 year lease with a Superfices agreement immediately. Include a receipt noting the lease has been paid in full for the amount you gave her to purchase the property.

I’m not married so it’s Lease and Superfices. You usufruct. What ever you signed at the Land Office negated all your rights. If you get divorced it’s hers.

You will then have a lease and rights to build a house.

I got great advice before moving Thailand. Someone told me to just figure what ever you buy and build be willing to and can afford to walk away from at the end.

Right now you have only made a contribution.

Study up, do your homework. Get to the legal website and read the contracts. Some of the websites let you read the entire document but you just can download a usable copy.

Really know something - I’m not cynical but I don’t trust Attorneys my own country why would you just trust Attorneys in a foreign country. I want to know and understand what they’re doing and why.

Moving to and living in Thailand is an on going process not an event with closure.

My 2 cents.

Secure your position now then work on the next thing.

Remember if someone says don’t worry about, worry about it.

Jeremy Miller and others me and my wife bought our land about 15 years ago, the wife went to put the land in our 2 daughters names last year ,she couldn't without my signature, as when we bought it we both had to put our signature to paper, to take my name off we had 2 options, signature for divorce papers, which would have fkd my visa extensions up or pay ,to get all done and finished it cost 97k

Michael Dawson after two years on the Non-O/A he would need money on his Thai bank account or 12-months of 65,000 THB transfers from abroad, plus he will be forced to get a Thai tgia-listed private health insurance. A Non-O/A visa he would need to fly back to the USA to re-apply every two years if he really wanted to keep the money in his home bank account

Don't worry I know many couples in successful relationships but they are expats living there. He has been for 8 holidays and thinks he understands Thai girls. I do wish him luck. Daren Liebig actually, if you think the comments are negative, you must be new to the group, or have only read a few posts. These comments do far, are accurate as far as foreigners owning land in Thailand is concerned, and yes, some foreigners have been caught out by building houses on land that can only be owned by a Thai national. A long term lease in the foreigners name on land, the actual house in the foreigners name and a legal document giving the foreigner the right to live in the house if the marriage ends, are the only way that they can legally stay in the house if the Thai wife ends the marriage.

John Kennedy I look at reality too. So I build my wife a house. If something happens and we split up it's her house. It cost me a lot less than my last divorce in the US. My ex and I were amicable too. Life is too short to worry about what if. 24 years with the last wife. This one is even more easy going.

My wife recently purchased land and I had to sign documents at the registration office which stated I had no interest.

Bottom line is unless you’re Thai you cannot purchase land.

In my case my wife purchased the land. I have to sign away any interest in it. If my wife wanted to buy land when I am on not in Thailand she cannot until I appear at the land registry to sign a document.
