It seems to be impossible to find reliable information on what is considered thai-sourced income vs. foreign-sourced income in the context of the DTV for the workcation people.

If you have an employer back in your home country, the money gets already taxed at source, so it's likely you could just get tax credit for that in Thailand. Or do it the other way round: Pay taxes in Thailand and then claim back the withholding tax from your home country's tax authorities.

But what about freelancers? Because there is no withholding tax, so you basically get exactly the amount you earn and everything is untaxed the moment you receive it.

For the most part, the definition of "locally sourced" income is always "the place where the work was performed, even if the clients are abroad".

This is really just to satisfy my curiosity, really. In Malaysia for example, on the DE Rantau visa, if you work in Malaysia but all your clients are overseas, it's still considered Malaysia-sourced. For the DTV, all I ever read is "foreign-sourced income is only taxable if you stay more than 180 days and only if it's brought into Thailand", which never really answers the question of "sourced income".

Anybody with experience?
Answer summary
The definition of Thai-sourced income versus foreign-sourced income for individuals on a DTV workcation visa is often unclear. Generally, if you work remotely without engaging with Thai clients, your income is foreign-sourced, but the situation complicates if income comes from Thai entities. If you stay in Thailand for over 180 days, you may be regarded as a tax resident, which requires you to file a tax return for all income brought into Thailand. Additionally, consulting tax laws and guidelines from reliable sources is advisable for accurate compliance.

This is one of the biggest grey areas with DTV. In general, the workcation category is designed around foreign-source income (clients, employers, or businesses outside Thailand).

If income comes directly from Thai clients or Thai entities, the interpretation can become very different and may raise work permit, tax, and compliance questions. The structure matters a lot — who pays you, where the contract sits, and where the business is based.

It’s one of those areas where being cautious matters, especially since embassies and tax rules may not always interpret it the same way.

When you send your clients an invoice - what is the address on the invoices that you send? Are any of them in Thailand? If not, then the payments aren’t originating there, and it’s not Thai sourced.

Thai sourced income to Thai authorities means income that is paid from domestic sources... Thats work permit controled for active income but also includes domestic dividends, cap gains, rental yields etc in passive income categories.

Non Thai sources are only taxed on remittances, not on income.

A workation based DTV gives you the right to work remotely from Thailand, you can't work with any Thai entities or clients inside Thailand. Your income is from your remte work so should be taxed where your registered for income. On top of that if you spend 180 days or more in a calendar year inside Thailand then you are also a Thai tax resident for that year and have to file a Thai tax return reporting all assessable income you bring in during the year. If the country where you're income arises us covered by a DTA with Thailand you can claim a credit against Thai tax for any tax already paid there on the assessable income you bring into Thailand

Your visa is not relevant to taxation unless you have a visa with tax exemption

Legally any income you earn while physically in Thailand is Thai source

It's different case by case, and so the DTAs are also different. Which is your other country?

It’s where you are m registered. If registered home country you get taxed there.

If unregistered and live Thailand with residency certificate etc then you get taxed in Thailand
