Given that many had their bank accounts locked due to weird visa situations. I have also heard many business had problems because of the proxy owner work-around.

What are the risks of buying a house under a Thai company. I see there are a quite a few homes for sell as Thai business... What are the chances of the business being seized and the property?
Answer summary
The conversation discusses the risks and challenges of buying property in Thailand through a Thai company, particularly for foreign investors. Concerns are raised about the legality of such arrangements, potential investigations by authorities, and the risks of dealing with nominee shareholders. Some community members share their experiences suggesting that while investing through a company can work, it carries significant risks, especially if the company structure is not legitimate or if it is simply a nominee arrangement. Others advise caution, highlighting that foreign ownership of land is legally restricted and that potential losses can arise due to legal complications, making renting a safer initial option.

Productive , actual , ongoing company , legal but not without risk .

Nominee company , doing nothing but holding property incorrect structure, and never correct .

So to the last part of your question = extremely good chance of happening , bottom line - was never a good idea , now = even worse idea .

But was not a good idea 20 years ago either .

Unless it's a really legit company, don't do it. They'll basically take the land and house, you just lost the entire investment, and you're in some serious legal issues. And no you don't get your money back either.

I've never heard of a case of houses purchased under a company having problems! But problems associated with home ownership are rampant all over Thailand! The owners, who are the leaseholders, die, or their new relatives. They want to get the land back, or the land ends up mortgaged.

Bro when you come to Thailand the money you bring class as spare change your prepared to lose it I’ve owned house via way of company and sold on never had a problem If you can afford it build 2 properties 1 for yourself and 1 to rent have a good accountant pay your taxes each year and you will have no problems people on here will say don’t have a company bla bla but 99.9 % have never owned a property any investment is a risk in Thailand been here 20 years and have more than quadrupled my initial investment if I lose it all tomorrow I move on ! Rent for the first 2 years and then decide what you want to do ! Life’s to short there are no pockets in shrouds you can’t take it with you ! By the way there are 1,000s of unsold apartments in Thailand I would rather rent than buy an apartment because it will take years to sell !!!!

Putting up a company with Thai nominees (51%) ONLY to buy is illegal. If your company is actually producing, it’s legal to buy land. A house itself you can always own as a foreigner.

How is it illigal if you can do it? You go to the prosess with land office and everything is stamped. Don't know how you can do this through government if illigal?

Jonny Larsson how simple is it? You cannot but land as a foreigner. If you manage to get all the stamps it is still illegal. Get caught, lose it

Owning properties in Thailand is the dumbest thing you can do. It is dead money. Also the fees of the Thai companies would bankrupt you

A Thai company can buy properties landed and condos. As long as it is operating a legitimate business and having to pay taxes for at least 1-2 years. If a company tends to hold a property with less then a year in business that can be considered illegal, due to insufficient accounting to proof the company can back the amount of the property bought.

You can buy condo legally (under the 49% foreign quota)

Non-Thais cannot own land and although in theory maybe some people have done it thru a company this is a huge mistake

If you have a Thai wife / partner they can own the land - but there are cases where the Thai kicked out their foreign spouse / partner

You can legally lease land for 30 years

Sooner or later they will investigate those condos and houses bought in illegal company name, question is when

Just read an article on Facebook where the police in Phuket are really cracking downnon nominees and Thai businesses where the Thai person is the "owner" with 51% but when the Thai Police question them they have no idea about the operations of the business. Expect this to eventually spread to the rest of the country.
