What are the key differences between a Work Permit and a Non-Immigrant O Visa in Thailand?

As we have regular new members, I think it is a good time

to explain some differences, as I see today people are getting confused about names.

a Work Permit is a blue book on your name, your employer applied for this at the Ministry of Labor and if you have this booklet you are allowed to work inside Thailand.

a Visa from an Thai Consulate gives you a xxx amount of days to stay inside Thailand, it does not guarantee that you are allowed to go inside Thailand, that is always the decision of the Immigration Office at the check point.

Not every visa has the same rules and regulations.

Most confusing seems to be the Non Immigrant O visa, where the O stands for Other, meaning there are different reasons to get this visa and every reason has his own rules and requirements.

Example for this Non Immigrant O:

- Being over 50 years of age

- Married to a Thai National.

- Being the parent of a half Thai child.

- Being dependent on a foreigner who has a long permitted to stay inside the Kingdom.

Al these Visa and Extensions of Stay are based on one particular reason based on your personal situation.

You can not just compare your situation with somebody else his/her situation.

Be informative if you ask advice, just I have a Non Immigrant O visa, raise the question on what reason did you get this visa. If you are not sure with the terminology of Thai visa or Extension, don't worry we all had to learn.

In that case post a picture without the personal data of your latest visa or stamps from Immigration.

We will explain what is what and it avoids lot of questions to you to find out what you actually have and most of all it will avoid incorrect advice if a person assume what kind of visa or stamp you have.

Thanks for all the questions and enjoy your time in Thailand.

TLDR : Answer Summary
This post clarifies the distinctions between a Work Permit and a Non-Immigrant O Visa for expats in Thailand. A Work Permit is issued by the Ministry of Labor, allowing foreigners to work in Thailand legally, while a visa allows for entry and a stay for a specified period, with actual entry at the discretion of the Immigration Office. The Non-Immigrant O Visa can be obtained for various reasons, including age, marriage to a Thai citizen, or family ties to a Thai national, each with unique rules. The conversation emphasizes understanding personal circumstances and encourages seeking clarification through documentation for accurate advice.

being in possession of a visa does not guarantee you access to anywhere. It isn't implied anywhere that entry is guaranteed either. This is the case for every country and is internationally accepted practice. The Immigration departments around the world can and do refuse entry to people. It isn't a decision they make lightly and so it isn't something that occurs regularly but they have to have that power/option to stop undesirables.

Great post and very informative. As an expat new to Thailand I am apparently very confused about what is what, and I didn't even really know I was confused until I got to this group ๐Ÿ˜. I'm not very confused anymore thanks to people here ๐Ÿ‘๐Ÿป

I like comment as: we are not welcome in Thailand, go there where the grass is greener. Correct, you're not welcome here. I felt free to use the leave group button for you.

Biggest confusion seems to be the difference between Visa ,which is issued by an embassy or consulate outside Thailand and extension of stay which is issued inside Thailand. Extension of stay can be for many reasons .An extension of stay based on retirement is often incorrectly termed "Retirement Visa" An extension of stay based on marriage can also be incorrectly termed "Marriage Visa.

And there is not even an Extension of Stay based on retirement. Can you imagine how confusing keeps going on? It is called Extension of Stay based on being over 50 years of age and willing to sit out the rest of their live inside Thailand. Yes I agree, it is shortened to save space inside your passport with the text: "Retirement".

I agree with
@Rob***
, pictures cannot lie (people do :O or at least they are easily confused ;) ). Rarely are people given bad advice once they post an image of what ever entry, visa or extension stamp they have in their passport :)

I think a glossary is indeed necessary. Many people seem to be confusing re-entry permits with visas, while they are entirely different things.

Also, another basis for non-O visas is volunteering.

For some people every thing is a visa, even after explanation is given they still call it a visa. Making a glossary and post it may help today, but not tomorrow. Just post the picture and we know what people are talking about in most cases. Yes another example is volunteering but I just mentioned a few, not all.

Well written...

Also a visa extension is not the same as a visa.
Robert *******

That is correct. a Visa gives you an Admitted to Stay period. And this Admitted to Stay period can be extended at local Immigration Office and is called an Extension of Stay.

Good timing for this post as many expats will be arriving in the mid summer or already researching.
