Hi there

Maybe there are some people who already faced similar issues, found a solution or are experienced enough to share some thoughts or so.

I am thinking of of getting the DTV, and I want to stay more than the 180 days in Thailand, which would in theory be an issue for my Swiss employer due to tax residency, different insurance topics and a potential permanent establishment issues.

Is there anyone who has experiences in such a setup, if there is an issue when staying more than the 180 days? Or, maybe there are people with different ways of how you did resolve this? Maybe with different business structure, self employment or so?

Looking forward to your feedback as I am very curious about it.

Thank you in advance!

There is a don't ask, don't tell policy going on if you stay longer than 180 days. Just don't make a scene anywhere and you'll be fine.

Anonymous participant 156 is your statement based on experiences or others which told you? I would guess the same but if I cannot be sure it is risky

DTV is a tourist visa, so you don’t get any resident status in Thaland.

One thing worth checking is whether your current health insurance will cover you during a long stay in Thailand. You could have a chat with the guys at

You won't cease to be a Swiss tax resident after 6 months. At a glance, it looks like the Swiss criteria is similar to Australia, which suggests that you'd need to go out of your way to break ties with Swiss tax.

The tax man in your many of our home countries usually likes to maintain ties, rather than let one just go silently.

Yes, you'll also become a Thai tax resident, but that has no effect on your employer or employment.

the real risk I read about several times is the risk of a ‘permanent establishment’ for my employer if I would exceed the 180 days, but I am not sure if that's a real problem, as from what you are saying, I also think that becoming a tax resident itself isn't a real issue.

Sounds like your employer wants you to maintain Swiss tax residency. There are rules governing this in article 4 of the dual tax agreement between Switzerland and Thailand. Things like maintaining an available home, spending a minimum of 30 days per annum in Switzerland can be important. It would be best to take some professional advice

from what I know, this is not sufficient and I read several times about the risk of a ‘permanent establishment’ for my employer if I would exceed the 180 days.

Anonymous participant again it's pretty comprehensively covered in Article 5 of the DTA. If all your doing is working remotely and you move around the risk is very small but if you're negotiating contracts etc the risk is high. If the DTA isn't enough for your employer then one or other of you should get a legal interpretation

Anonymous participant the permanent establishment depends upon what you will be doing in Thailand. They, understandably, don't want to risk creating a permanent establishment for themselves in Thailand and creating corporate tax liabilities for themselves as a result.

Would you lose your Swiss tax residency? I'm here since two years ago, working for a company in my home country where you CAN'T lose tax residency if you get income there every month, like I do. It's seems it's mostly European countries where you can lose tax residency (and even legal/administrative residence) rather easily.

I would just keep Swiss tax residency. No issues.

But, I'm not Swiss citizen, neither are other replies. You should ask at a Swiss' living abroad group.

Speak to your employer or it sounds like you run a very real risk of having your employment terminated to save them a lot of headaches and unnecessary financial expense.

Could you not set up a limited company in your own country and contract to your main employer through that company?
