I own small company and my one year non-b expires on Feb. What would be the consequences of delaying the extension? Would I just lose my visa, or also the company? Would that cause immigration officials to visit my office? Would I be a able to apply for the visa later?

TLDR : Answer Summary
Delaying the extension of your non-B visa could lead to several consequences. Firstly, you may incur a fine of 500 THB a day for overstaying, up to a maximum of 20,000 THB. If overstayed for more than 90 days, you risk being blacklisted from entering Thailand for 5 years. While your company can remain active if you maintain accounting and tax obligations, you will need to cancel your work permit and non-B visa. You may be able to apply for a 60-day COVID extension before the visa expiration date but cannot work under that extension. If immigration officials catch you while overstaying, it could lead to severe repercussions, including possible jail time.

Do you mean you have multiple entry Non-B or you are on extension (6month or 1 year) based on employment/working?

If you are on long-term extension based on employment under your own company, your WP is connected to your extension. But if you are on Non-B multiple, the link between the two is different.

Company existence is a totally different thing from the owner/director's visa status.

I believe *COMPANIES* are separate legal entities to the business owner. However, if you delay renewing your extension of stay, you will be fined 500THB a day, with a maximum fine of 20K THB. If you are overstay longer than 90 days, OR caught while on overstay, you will be blacklisted for 5 years.

for information.

> Would I just lose my visa

Keeping it simple; You would lose your visa (or, technically, your right to stay in Thailand on your existing stamp)/ extension of stay, and you may have to restart the process over (leave Thailand, get the paperwork for the visa, re-enter..)

>Would that cause immigration officials to visit my office?

I understand you can not work while on overstay. If you are caught, you will be blacklisted for 5 years.

>Would I be a able to apply for the visa later?

If you are blacklisted, you can not enter Thailand for 5 years.

I believe you can keep your company as long as you continue your accounting, taxes, etc. but you will need to cancel your work permit and your non-b, then apply for the 60 day covid extension before January 29th.

You might still be able to reinstate your non-b and wp, if there’s no lapse in visa, if all your company requirements (with employees, social security, etc) can be met in the near future.

>then apply for the 60 day covid extension before January 29th.

The OP Can not work on a 60 day extension of stay based on COVID-19. I also understand it's difficult to go from a 60 day extension of stay based on COVID-19 back to a one year extension of stay based on employment.

all of what you just said seems accurate. I never said it would be easy, just I think I can be done. It’s my understanding that the COVID extension is based on whatever your last visa was, so for him it would technically be a temporary covid extension of his non-b, which is why as company director if his own business or even as a new hire for a company that meets the requirements, it would be possible to get a non-b and work permit.

If I’m wrong, then I apologize. Maybe Tod knows better

If you lose the B then you lose the WP as far as I know. No visa of any descriptio n would invite big trouble not to mentio n an overstay charge of 500 baht a day. Continuing to work could result in jail and deportation at your expense.

I suggest you do not wait...as you state your unable to meet the requirements to obtain the one year extension of your business based Non B.

go to Thai Immigration not later than January 29 and apply for a 60 day COVID extension.

And you cannot work under a COVID extension.
