Hello, I wanna do a 3rd border run this year. I’m Canadian. Someone know a good agency not too expensive who accept to do this ? I’m from Bangkok.
Summary so far
A Canadian expat from Bangkok is seeking recommendations for affordable agencies that facilitate border runs, indicating this is their third run of the year. The comments reflect a range of opinions, with some users sharply criticizing one another and discussing unrelated issues regarding property laws and immigration concerns.

Has anyone had a knock on the door from government officials or received documents from the DBD about their property? Or do you know someone where it's happened to them? Interested to hear about it. Thanks...

They are going after the big fish right now. 10 million and up. If your house is in a company name. You have make sure it was set up correctly. Have independent lawyer look at the set up. If it's already in your wife's name this doesn't affect you.

If you are an American, you can own the business 100% after you can buy land under that business. The house you can put under your personal name and you rent the land under your business.

Elite Visa and such Land papers all confis..

Police took 13 foreign nationals into custody in Hua Hin on Monday in connection with pool villas and houses said to have been held through nominee company structures. Several of those detained told officers they had been advised to arrange the holdings that way by Thai law firms and accountancy firms.

More than 200 police and government officials joined the operation, the sixth phase of a nationwide campaign targeting foreign nominee networks. The raid focused on properties in Thap Thai subdistrict, each estimated at roughly 10 to 20 million baht.

Investigators identified six companies that held the properties and determined they had been registered with Thai nationals listed as nominee shareholders.

Courts have issued arrest warrants for 45 foreign nationals and summonses for 39 Thais. Those arrested on Monday comprised three British nationals, four Chinese nationals, and one each from Italy, France, the Netherlands, Austria, the Philippines and the United States.

Some of the Thai shareholders acknowledged holding the shares on behalf of foreigners without contributing any capital of their own. Officers seized company records, accounts, computers and mobile phones and will follow the financial transactions to identify additional participants. Police indicated they will also look into whether any officials helped facilitate the arrangements.

The explanation given by several of those arrested is the one most likely to be repeated: they wished to purchase property, a law firm or accounting firm established a Thai company to hold it, and they understood the arrangement to be lawful.

That understanding is not a defence under Thai law.

A company that holds property must be a genuine operating company whose Thai shareholders have actually invested and exercise real control. If the Thai shareholders exist only on paper, the structure remains unlawful regardless of who recommended it, and both parties are liable.

The fact that such advice has been widely given does not make it correct. This model has been routinely marketed for years, which is exactly why enforcement operations continue to uncover dozens of such companies at a time.

If you are a farang, & bought a house in a Ltd company with a nominee, who has not put any money in, and it's used as your residence and not as a business, expect a knock on the door, you will loose the house and probably get deported. You are breaking the law

You need to think further, when you have a hous and your thai wife passing than the land will go to the children or sister/brothers of your wife. Get in contact on Lawyers for Expats on Facebook or on WhatsApp +66

What a BS. Half Thai does not exist, they are Thai citizens with Thai ID and Thai passport. Nobody will go after them.

My daughter, by documents, does not differ from any Thai person. No humiliations like TM30, 90 days reporting, visas, nothing.

She can own as much land as she can buy, anywhere in Thai where sales are open for Thai nationals.

Thai laws.

Foreigner can’t own land. He can own condo or lease land.

He can be shareholder in a company that own the land, if that company is legit and was established for real business purpose, with real Thai ownership of minimum 51% of the shares, held by Thai partner that can prove source of funds for the investment.

The company can’t be established just for the purpose of holding the land, unless that is its declared business (hotel for example).

If the company rent out the house on the land, it can be done for long periods (over 30 days per guest) - otherwise need to get hotel licensing for short term rentals.

Anything else is grey area and can escalate very quickly to black zone and lots of headaches.

Follow the laws, it’s easy and painless if you just do things the right way, we are guests here even if we are here for 30+ years with Thai families etc.

Ben Horovitz he can be shareholder to own the land but if the Thai shareholders can’t prove how they got the funds to buy that land, it’s also a problem
Ben **********

Johnson Lau a company that established for the sole purpose of the foreigner to be holding a land, is illegal by Thai law.

It's not about the vill/ house . It's about the land its on . How that was purchased . If you set up a company with unknown thai partners that did not finance the share holding of 51% then they are paper partners referred to as nomanee partners . Meening they do not control the company . They are not real partners in said company . Therfore it is an illegal set up for the land ownership . It's been a normal set up for many years . This new gov are now enforcing the law . Many people will be affected as many agents/ lawyer used this set up for many years but alas because everyone dose it that dosnt make it law . My advice would be contact a lawyer ( not the one who set up your company) and get advice on how to fix the problem .

@Tony *****
how can you fix it?? your name is in the company list. You are the owner of the land, the register of the land is also under your name and your company name. too clear, too late.

You have to sell it quickly, most likely only Thai will buy, this includes Thai nominee structured condos also that you need to sell. These are breaking the law and possible legal problems and deport.

If you have a house

In your name

Your wife’s name - not a business name - you are fine

If you have a house in Thailand

And , on paper , you own 49% of it with 51% in the name of a Thai nominee company - you need to get that fixed - fast !
