We, my (Thai) wife & I have been pursuing a Green Card, Spousal Visa legitimately for over 2 years now. We got our I-130 application formerly received in January,’24. She, meanwhile acquired a Visitor’s Visa for the USA that allows her to stay for up to 6 months for a 10 year period. She came to the USA for 2 months in ‘23 & again in ‘24 for 5 months. Having returned to Thailand November 1, ‘24 she is patiently waiting more, but wants to return to me soon.

Since USCIS says 14 months is the minimum time until her “interview “ she’s reluctant to return before March,’25. Can she do her interview here in the USA, thereby allowing her to return here(USA) in say, February or March? Tired of this red tape bureaucracy.

TLDR : Answer Summary
A Thai wife on a Visitor's Visa is inquiring about the possibility of attending her USCIS interview for her Green Card application in the USA before the waiting period of 14 months is over. She has two months of stay in 2023 and five months in early 2024, and is hesitant to return under visa constraints. Comments suggest various opinions on her visit options and the complexities surrounding immigration procedures.

I think you will have to talk to immigration in the US.

Why can't she come visit the US? Her visa is valid for 10 years. Sounds like she can visit as many times as you're willing to pay for the trips. Did you get a K1 visa for her?

Besides what

mentioned she could be denied the entrance base in frequent trips too. It’s up to the USCIS not his willingness or ability to pay.

not eligible for K1 if they're already married. Sounds like they're going through the marriage route which can take a little longer than K1 but recent reports are that the time for both are pretty similar currently.

On a better notes; USCIS waiting time now is much shorter than what we have to wait back in 2006 . The

came along and I ended up have to write to the President and the First lady begging to be with my two young children who were 8 and 10 at the time.
