Thanks for letting me join the group.

I have a non immi retirement O multiple entry visa.

Expires February 05, 2024.

Last entry will be January 08, 2024.

This will give me a 90 day allowance to stay until April 16, 2024.

Immigration in charge is Chiang Mai.

Can/should I apply for the EOS within 45 days before the expiration of the visa (I. E. right after my arrival on January 08), or the allowance of stay (after February 20)?

TLDR : Answer Summary
The user has a Non-Immigrant O retirement visa expiring on February 5, 2024, and they are inquiring about applying for an Extension of Stay (EOS) after their entry on January 8, 2024. It is clarified that they should apply for the EOS between February 21 and April 6, 2024, as their last entry stamp allows them to stay until April 6 despite the visa expiration date.

I didn’t know this. Just to double check - you are given a 90-day stay until April 6, even though your visa expires on Feb. 5?

@Lee *****
, visa expiry means that is the last day you can enter on that visa. Entering on that visa means you will be stamped for the number of days that visa allows once you are allowed to enter.

As you said, apply for an extension of stay based on being over 50 when you have less than 45 days of your entry stamp, not a visa itself. If you enter on 08 January 2024, your entry stamp will be until 6 April 2024 (not 16 April). You can apply for a 1-year extension between 21 February and 6 April.

Or

Go border bounce for the last entry on or before 5 February to get another 90 days, and push the extension application about one month after.

Thanks. Of course, as you noted, allowance to stay will be April 6, and not April 16. My mistake. Will apply for the EOS and a re-entry permit on February 21.
