TLDR : Answer Summary
The user previously spent 180 days in Thailand and was denied entry upon trying to enter Phuket. They are concerned about potential issues when re-entering Thailand by land in January, especially related to immigration rules and past entry denial. Commenters suggest obtaining a proper visa, as previous denial is likely recorded and could affect future entries.

Time to get a visa.
Ralph *******
Get a visa. They’ve already explained why you have been refused.
Daniele ***********
Did you have all requirements? 20k cash, accommodation and outward ticket? Did they ask for that?
Sandor ********
ORIGINAL POSTER
@Daniele **********
I would leave TH the same way, by train, but I can buy a train ticket. 20k cash no problem, and accomotation also ok, I can book.
Daniele ***********
@Sandor *******
so did they ask for that? Did you show that?
Sandor ********
ORIGINAL POSTER
@Daniele **********
yes, but I stayed too many days in that year in Thailand earlier. That was the problem.
Daniele ***********
@Sandor *******
there's no law that limit how many days you can stay, what's the reason they stamped in your passport?
Sandor ********
ORIGINAL POSTER
So, my question: Does it matter that it will be a new year when I would like to enter?
Steven *******
@Sandor *******
There’s no reset at the beginning of a year.

@Steven ******
ok. Thank you πŸ™

doesn't make any difference

@John *********
ah, ok. This was the most important for me. Thank you.

Nobody can answer this question other than the immigration officer you will stand in front of, but the fact you were denied entry is likely recorded on the immigration database. It sounds like time to get a proper visa for the reason you spend so much time in Thailand
Nate ******
Move on to Vietnam πŸ‡»πŸ‡³, it’s way cheaper to stay in there .
Paul ***********
Which is their right if they believe you are abusing the system somehow..

Did you overstay your visa or visa exemption in the past ?

180 days is quite a long time in Thailand..

How did you stay that long without overstay ?
Sandor ********
ORIGINAL POSTER
@Baz ********
No, I overstayed once, only few hours, and I paid 500 THB fine.
Baz *********
@Sandor *******
That was no doubt noted on your passport records with immigration and enough for the immigration officer to take a closer look at your travel history and become suspicious you are not a genuine tourist.

One small mistake is all it takes..

I think your only option is to apply for a tourist visa before you try entering again..

If you cannot get one then consider Phnom Penh Cambodia as that's an interesting place to visit and long term visa are easier to get if you have money..

@Baz ********
Ok. Thank you πŸ™
Maksym ***********
@Baz ********
you can stay for years on stamps with border runs. Nothing hard
Mark ******
@Maksym **********
until they flag you.....and they will eventually
Baz *********
@Maksym **********
Yes I understand very well how border runs work..

But why was he refused entry back into Thailand ?

Immigration must have had a reason for refusing entry
Kim *********
@Baz ********
yes and the reason was given 😏
Maksym ***********
@Baz ********
because after 6-9 months you are not looking as tourist. So any officer can ask why you enter again without visa and deny. Only protected entries under borderruns and green corridors will be safe with extended living in Thailand under visa exemptions. Because visa exemption is for short trips, not years 😁
Brandon **********
@Maksym **********
define tourist to me????
Maksym ***********
@Brandon *********
tourist is a person who don't work in Thailand. but if you live here for a year, Thais don't believe you are not illegally working here.

I showed them my balance, they realised I dont have to working in Thailand. Bro, why would I working in TH, when I could work legaly in EU? In Thailand, salary about 3-400 Eur, in EU 1300 :D
Maksym ***********
@Sandor *******
foreigners don't work in Thailand for 400 eur. They work for 1000-2000 eur, or even more ;)
Baz *********
@Maksym **********
So what you are really saying you can stay as long as you like by using border runs for a long period of time but you trap yourself in Thailand because if you leave for any period of time there is a chance you will be refused entry if you try to return?

Doesn't sound very smart way to do things and as already pointed out also quite expensive.
Graham ******
@Baz ********
because things have changed and you cannot stay long term using border bounces
Maksym ***********
@Graham *****
you can't without paying for this πŸ˜‚
Andy ************
@Maksym **********
Expensive way of staying! πŸ˜‚
Daniele ***********
@Andy ***********
some people like to travel, I could get a visa but traveling out Thailand every 2 months to get a new stamp is also fine for me
Andy ************
@Daniele **********
I love travelling. I'm on a non-O but haven't filed a 90-day report since covid ended. I just love paying 1900 baht per year and don't have to be continually counting days.
Daniele ***********
@Andy ***********
well, you still have to count 90 days and visit immigration if you don't go out before that, you also need re entry permits before going out
Maksym ***********
@Andy ***********
before DTV it was most cheap way, no? 4000 thb every two months
Mark ******
If you get a proper visa, you should not have any problems. Unless, there is a story behind this
Daniele ***********
@Mark *****
lol what's a proper visa for someone that want to be a tourist for more than 180 days?
Mark ******
@Daniele **********
check with your embassy/consulate. If you want to play games with immigration, it's totally up to you. Many countries get 60 days + 30. You could leave, and enter again for a further 60+30.....if Immigration officer will allow that

@Mark *****
yes, this will be the final option.
Baz *********
@Sandor *******
It should be fine first option always..

Follow the rules and then you don't have any problems
Mark ******
@Sandor *******
that should be top option!:) good luck
Sandor ********
ORIGINAL POSTER
@Mark *****
Yeah, but I am thinking to go back to Europe for 2-3 years, thats why I would like to avoid the DTV now. πŸ˜ƒ
Mark ******
@Sandor *******
well, if immigration have already flagged you, it will be totally up to the immigration officer, at point of entry, whether to let you in or not. Most probably, your name is down in the system already....good luck
Sandor ********
ORIGINAL POSTER
@Mark *****
With DTV will be no problem.I was thinking, new year will be in 2025, and I can stay again 60 days as a tourist.
Cissi *********
@Sandor *******
no, your entry history does not reset because it is a new calendar year. As someone mentioned already, you are most likely "flagged" in their system as being warned and denied entry and you are likely to be denied one more time if you try after just 2 weeks.
Sandor ********
ORIGINAL POSTER
@Cissi ********
Last time when was denied was this year september, so the next will be not only after 2 weeks, will be more than 3-4 months.
Mark ******
@Sandor *******
with DTV you are allowed 180 days, every time you enter.......
Samuel ********
Why did they refuse you?
Sandor ********
ORIGINAL POSTER
@Samuel *******
"You stayed too many times, you are not a tourist"
Samuel ********
@Sandor *******
oh with tourist Visa, I See
Cissi *********
@Samuel *******
more likely with visa exemption and border runs...
