Hi Team and thanx ffor entry to the group. I'm Australia, Thai Girlfriend and looking to apply for Retirement visa.

I trying to figure out what appears to be a catch 22 situation.

I'm over 59

Monthly income/ pension is well over the required amount and I meet the remaining criteria. However:

Apparently the Australian Embassy no longer issue the proof of income certificates. An agent informed me, that because of this, I'm required to meet the 800,000 baht bank deposit requirement and then use the following yrs Thai bank statements to qualify under income.

But so far, I've been told I can't open a Thais bank account without a Retirement visa and I can't get a Retirement visa without a Thai Bank account.

By the way, I spoke to an agent who reached out and was told this.

The visa agent firm can do a Retirement visa while I am in country under a 60 day visa free entry, and will front the 800000 bank account for me whilst walking me through the application, immigration etc all in one day and my 60 day visa free entry will roll into my retirement visa. I land in Bangkok and 1 day later, bingo, I have a Retirement visa. All at a cost of 60000 baht. Apparently the firm has a special relationship with the bank for the bank account with 800000k.

Well they say if its to good to be true - you know the saying.

Any info or references would be greatly appreciated.

Thanx in Advance,

Mike
Answer summary
An Australian expat seeking a Retirement visa in Thailand faces a challenge due to the inability of the Australian Embassy to issue proof of income certificates. While he meets the necessary criteria (over 59, sufficient income), he’s caught in a perceived catch-22: he can't open a Thai bank account without a Retirement visa, and he can't get a Retirement visa without a Thai bank account. Community members advise securing a 90-day Non-O visa before arriving in Thailand, which can be obtained with proof of sufficient funds in Australia. Upon arrival, he can open a Thai bank account, deposit 800,000 baht, and then apply for the Retirement extension after two months, negating the need for income certificates. Multiple participants caution against using agents for shortcuts due to potential legal issues and emphasize that it’s feasible to complete the necessary steps independently.

I paid an agent in Chiang Mai over 43,000 baht while in the USA for a 90 day non 0 retirement visa and then moved to CM within the first month and they helped with opening a bank account with Kasikorn bank. Before the 90 days was up I got the 12 month extension all with the help of the agency. FYI..... by the time my 2nd extension was due I was able to do it myself.

You can open a bank account on a Non O Visa, after you get the visa fly in get yourself a phone, go to immigration get your resident certificate go to the bank, preferably Not Bangkok Bank , Kasikorn bank is one of the easiest to open a account, deposit your 800,00 before your first month here, 60 Days later go to immigration and get your retirement extension

If you intend to spend more than 6 months in the country then don’t forget then you’ll be liable for tax on any money you bring in so you’ll need to not only bring in your 800k but also enough to cover the tax on it.

Mike don’t listen to this mick he doesn’t know what he’s talking about and he shouldn’t be advising you on tax requirements in Thailand he is not qualified nor I assume not a Thai national so he’s breaking the law.

Take it from me you have no liability on your Australian pension in Thailand whatsoever and it’s got nothing to do with the agreement between the two governments so don’t worry about that.

Mike it’s obvious to me there are others giving you advice and honestly just walk.

Go to a respectable agent it’s cost you nothing to enquire don’t listen to others they are scammers that’s rubbish.

Compare a few agents and ask about costs etc you basically want it all stream lined. That’s my advice.

Mike honestly the Australian government won’t do you any favours in regards to a pension they put obstacles on the roads path and our friend said he’s finding that out.

Mike honestly come to Thailand spend a day going to a couple of respectable agents and enquire.

I personally know some of the problems in Thailand because my wife is a Chinese national and we had to open another bank account for her and man did we have some issues.

I was recommended to go to this Englishman and his Thai partner Pom visa business best decision we made I avoided the headaches and stress.

We went in on a Wednesday and she had the other bank account opened on the Sunday.

Chinese passport holders it’s hard believe me.

Anyway good luck

Mike I share my personal experiences that have actually happen.

I do my own 90 days, TM30, entry visas if we leave the country, residency certificate.

I even obtained both diving licenses myself, car, scooter transfer the car one I had to to Bangkok while day gone 8:00am to around 4:00 it’s crazy.

Visa renewal I prefer paying for an agent to do its simplest way I have found.

Mike another word of advice when in Thailand keep your frustrations to yourself while dealing with Government and banks believe me I have seen it all people spitting the dummy insults the Thai. Then they will straggle to get answers.

Clam and smiling helps your cause I have found with Thais.

Mike good luck with everything one step at a time it will slowly comes together.

Why would you give 60,000 to an agent when you can do it yourself unless you have tons of money..you come in to the country either with an exemption or tourist visa or if you find it easy a non-o visa purchased from your local Thai embassy. Then after you register at your hotel ask for copy of TM 30 foreigner registration form.go buy sim card for your phone, and register your passport to it.Then go to your nearest immigration office and tell them you want to convert to non- o visa which is I think valid for 90days I think (might be 60)and ask them for handout to see what documents this specific office requires for the 1 year extension (they are not all the same)Then ask for a certificate of residence to allow you to open bank account.Pay the immigration 2000 baht and that's you sorted for 90 days then you have to go again to immigration with your documents pay another 1900 baht and that's you sorted and saved yourself

You cannot enter visa exempt or tourist visa and do it this way. You must have a bank account to convert to a non-O visa, and you cannot open a bank account as a tourist. Hence using an agent who can do all of those things.

What catch-22? Get the 90 day Non-O visa based on being 50+ yo before you travel to Thailand. Show you have the equivalent of 800k Baht in your home bank or any bank. No catch-22 here since you already have the money in your home or any bank. After you arrive, get an apartment lease, have the landlord file a TM30 report with immigration, and get a locally registered phone number. With the lease and TM30, get a residency certificate at immigration, then with all the above docs, you can open a bank account, with the green, purple, or yellow banks. This may take several tries, like rolling dice. Folks here advise against the blue bank. Do a wire transfer from abroad and deposit a minimum of 800k Baht which must be in the new account for 2 months *before* you can apply for a 12 month extension of stay. Apply within the last 30 days before your permission to stay expires. Every other IO has slightly different rules, based on the roll of the dice, so visit and ask questions at the IO before hand. Still no catch-22. We all do it without agents. After a while, you may even sign up as a volunteer assistant at the IO. They all speak English, even French, German, Chinese, etc. No work permit required. No joke.

Everyone makes money , all stamps are legit and done completely at head office of Immigration in BKK.

That's simply the easiest to get around all this unnessacary BS going on in this country these days.

Please dont write in and say its illegal because its not.

Tom Pola I read on this group that a year later, on the next extension request, that one has to show a bank statement covering 12 months to show the bank balance did not drop below 400k THB... of course, an agent and a fee should cover this.

Mike he mentioned it over dinner his original plan was retire in Thailand and use his own personal superannuation.

He assume he could just apply for the aged pension to at least put some money back into his financial fund.

He told us If he left Australia, returned, and started getting the Age Pension, you must live in Australia for a continuous period of two years before your payment is "portable" (allowed to be paid at the full rate if you leave). If you leave before the two years are up, your payments may be reduced or stopped.

He been living on and off in Thailand and told us if he applied for the pension he said he had to stay in Australia for two years.

He said it’s the principle of the matter that he wants the pension but the assets test he believes is going to bite him as well.

He said he felt too many obstacles in the way even if he done the right thing and ended up getting the pension and he left Australia again he believes and felt the government will only make it difficult for him when he returns.

So if he uses his own personal superannuation it’s eventually will become affect is overall expenditure.

So he’s looking at options now.

I recall someone posted it’s easy now but that’s not what he told us.

We don’t have his issue so don’t know a lot about it sorry.

John Stanners answer is correct however I will add, the funds are meant to be yours. Currently the agents get around this regulation and drop the money for like 5 minutes. Exactly how, well people have their opinions. You are however intentionally circumventing the immigration rules, you are breaking the law . Before all the know it all's chime in I am well aware compliance is non existent and thousands get away with using an agent to provide the funds. That does not make it legal and to me breaking the law & falsifying any part of your visa application is not a good start to your new life in Thailand.

You need a 'long term visa' to open a bank account and a O-visa is a long term visa that you get before coming to Thailand. You need to have 800,000 Baht in a Thai bank account for 2 months before you can apply for an extension of stay (it covers 12 months). There is no catch 22, all you have to do is come to Thailand on a O-visa then go to your local Immigration office with proof of where you are living (rental agreement etc) and get a 'residentcy certificate' then take that with your passport and some banks need extra documents like the rental agreement, it varies between banks & branches, and that allows you to open a bank account. I don't recommend Bangkok Bank as there's be a lot of reports of problems with them but Kasikorn appear to be good. Once you have your bank account you can transfer the 800,000 Baht then after 2 month and before your 90 day O-visa expires you can apply for the extension of stay. If you want to change to the 60,000 Baht a month route then you need to transfer that every month for the 12 months and then for the next extension you can use that but if one payment gets missed or delayed then you wil probably have to revert to the 800,000 Baht in the bank but remember that you must never drop below 800,000 in the bank for the 3 months after the extension is granted and then it can drop to 400,000 but must go back to 800,000 Baht 2 months (some offices say 3 months) before the next application.

You get the non O while in Australia, using 800,000 equivalent in an Australian bank.

Then go to Thailand, open account, deposit 800,000 and apply for one year extension.

No catch 22.

you can use original income proof or a bank deposit in Australia for the application to the 90-days Non-Imm-O Retirement Visa (the online e-visa). In Thailand, you can get a Thai bank account opened on this visa type, and you must transfer a minimum of 800,000 THB into it ASAP. Because on the day you apply on Immigration to the "1-year retirement extension" (the one-year extension of the stay permit based on retirement which is referred wrongly as being the "retirement visa" but which is not a visa at all) the 800,000 THB deposit must have been sitting in your Thai bank account for 2 months, and you need the bank letter to prove it. That means that after you entered Thailand, you have about 2 weeks of time to get your ducks in a row, a bank account opened and the money transferred into it

You can't go from visa exempt to 12 month retirement extension. You go to a 90 day non-o, fund your account for 2 months and then get the 12 month extension. The visa and extension are 1900 and 1900 each. The rest of the 60k you pay is tea money and profit.
Greg ***********
Greg ***********
Stephen Woods you are not 100% right. . . . .You definitely CAN go from the visa-exempt entry to an initial 90-days Non-Imm-O Retirement Visa on Immigration inside Thailand. It is called "change of visa type". The only pre-requisite for an Australian citizen who cannot use an income affidavit of his embassy for the financial proof, would be 800,000 THB sitting in an already existing Thai bank account in his sole name. Which he CANNOT get opened on a visa-exempt entry. This is the only downside. If he was a citizen whose embassy issues an income affidavit, he would certainly be able to enter visa-exempt, get the initial 90-days Non-O Visa and then the subsequent 1-year extension of the stay permit

John Stanners answer is spot on. Apply for and get your 90 day non o in Aus, open your account when you arrive. If first bank says no go to the next, eventually you will find one that says yes. Once your money has sat in the account for the required time get your bank letter, statement since opening, lease and go to immigration (depending on the branch of immigration you use - check their specific requirements- take all your documents, two passport photos and 1900 baht to extend your stay for a year.
Doug ******
Doug ******
Stay away from an agent opening your bank account via back channels and doing your visa if you want to cleanly change later to doing your own visa based on monthly deposits. As others have said, it’s easy to enter on a 90 day Non-O visa issued in Australia. When you arrive you open a bank account immediately and transfer the required 800,000 baht into it. The money needs to be in the account 2 full months before you can do the 1 year extension.

Also, if you plan on converting to the monthly transfer method you need to start that right a way so you can show the monthly transfers for a full year when you do your extension for the second year. Note that you need to fully meet the 800,000 banked method requirements AND the monthly deposits for that full year if you want to convert methods. Miss one month of transfers even by a day and you won’t qualify. It’s often easier to just do the banked 800,000 if you can afford it.
Dan **********
Dan **********
Doug Mann yes. Although a clause in the requirements does state that the equivalent of 12 months payments is accepted, I had my 12-month regular payments refused because a bank holiday + weekend meant that one month wasn’t paid on the 28th and instead went through in the first days of the following month. That therefore didn’t count as 12 “monthly” payments and required many baht to fix.
Paddy *****
Paddy *****
Dan Morrison if you transfer money in the beginning of the month you will not have that problem. Also it is better you collect your pensions in your own home account and transfer them to Thailand yourself
Dan **********

Paddy Kan this was regular salary from an international payroll company. Transfer date and bank delays are out of my control. +/- 1 week depending on holidays.

Due to both tax and fees, having it sent to my home country and then sent out again to Thailand manually didn’t make sense.

But what really didn’t make sense was having a human look directly at the statement and then claim that I hadn’t received 12 monthly payments.

The trick is to apply for the 90 day Non-O visa before you come to Thailand which you can do showing income or savings in your home bank. When you get to Thailand you can then open a bank account and fund it with a minimum of 800k baht for two months before you apply for 12 month extension of stay. You have no option but the 800k method for the 1st year as your embassy stopped providing income certificates. For 2nd and subsequent extensions you can use monthly income by showing you have made 12 months worth of 65k baht transfers every month from overseas immediately prior to applying

If you have the money in your Superannuation account is that form of proof adequate as I would rather leave my money in there as the interest is much better than a bank. Graham Seal i have always found this false rhetoric a bit off. You are not, in any way. 'stuck' with an agent at all. 1. You chose convenience in using an agent. You are likely to continue doing so especially if you want to keep your 800k working for you in home country. 2. You can simply exit thailand and re-start the process if you wish to 'break up' with your agent for some reason. 3. You can move directly from agent visa to LTR without leaving the country.
