Do I need to pay Thai tax? Aussie on a DTV, no Thai income

I’m on a DTV (soft power) and will be in Thailand 10–11 months a year, so I’ll be a Thai tax resident. I have no Thai income. I live on Australian savings and bank interest, already taxed in Australia at about 10%. I spend up to about 1.25M THB a year here, mostly by foreign card and ATM.

Am I actually required to file and pay Thai tax? And if so, does the Australian tax I’ve already paid cover it under the DTA? Keen to hear from anyone who has actually dealt with the Revenue Department, rather than general opinions. Thanks!
Answer summary
An Australian expat on a DTV visa must file taxes in Thailand due to spending significant time (10-11 months a year) in the country. Even without Thai income, the individual is considered a tax resident and is technically required to report foreign income. However, thanks to the double tax agreement (DTA) between Thailand and Australia, any income already taxed in Australia may not incur additional taxes in Thailand. Most expats do not report their income, but establishing a formal tax filing might be advantageous for future visa applications.

DTV is a longer term tourist visa - Its a good visa for those of us that treat it as such.. by saying you will stay 11 months of the year you are virtually abusing it and simply living in Thailand with a 2 week holiday twice a year... Yes you will be a tax resident.. You wont be a tax resident in Aus so should be taxed on earnings... If you want to have a retirement visa (i. e. Not working) you should apply for the correct visa type..

Anonymous participant 471 yes you can, you do 180 days and either extend or out for a day and back in to reset your 180 - rinse and repeat for the 5 years

Yes, you need to file...regardless of whether you'll end up paying anything or not. It is best form to establish a paper trail in good faith. Maybe you want retirement visa or PR in the future...if you have history of avoiding their tax system, that will disqualify your application. You likely won't pay anything or much at all. Why risk it?

if you pay tax in Oz, then no as Thailand has a bilateral tax arrangement with Australia. Technically you should file but as others say, most dont (the way Thai treats foreigners now that may be the next thing they chase..555). Pro tip - if you withdraw from atm from oz bank, make sure to select dont convert currency to save conversion fees. (i think the yellow KrungSri ATM's have this choice - i use Thai cards so I cant confirm for other Thai ATM's)

there are levels where the Australian taxes are lower than the Thai taxes so 'if you pay elsewhere your covered by a dta' is not as simple as that.

The legal position is filing, showing the documented tax overseas, against the Thai liability and one either covering or part discounting the other.

Legally it's file and proof not an honour system.

You have to file for taxes, and technically yes for any money you bring into Thailand, but if you’ve already paid tax in Australia on the money you remit that effectively it should be zero. Realistically I doubt many people on dtv report anything but they should
