My friend is Thai. She married with a remote worker foreigner. He has contract employment and they want to living in Hua Hin at the end of this year. He plans to buy a condominium in Thailand for living in year 2025.

Can he apply DTV visa (5 years) or he must apply Marriage visa?

In Employment contract must write his income per year or monthly?

Tax point, if he stays more than 180 days per year ... he must declare income in Thailand?

If yes from A or B or C ?

A. money which he transfer into Thailand for living

B. his income from his country

C. no tax in Thailand because his income is not get in Thailand

Thank you.

TLDR : Answer Summary
A foreigner married to a Thai citizen can likely apply for a Marriage visa instead of a DTV visa, which is intended for those working with remote companies in Thailand. Regarding taxation, if the foreigner stays in Thailand for 180 days or more, their income transferred to Thailand for living purposes becomes taxable. They would need to file a Thai tax return and may be eligible for tax allowances and credits based on any existing tax agreements with their home country.

He would probably be better applying for the marriage visa than the DTV which is designed for working inside Thailand but for remote companies.

As to the tax situation if he transfers income into Thailand it becomes assessable for Thai tax if he is tax resident in Thailand, that is he spends 180 days or more inside Thailand in a calendar year. He would then need to complete a Thai tax return.

Whether he actually ends up having to pay tax will depend on his circumstances, how much he brings in to Thailand etc. Everyone is entitled to the allowances provided in Thai tax law, then if he's from a country that has a dual tax agreement with Thailand he can claim "credit" for tax already paid on the income he brings in
