Am I eligible for the LTR Visa in Thailand with my current employment and income history?

Hi Guys

Need your input on LTR Visa

I am an Indian Resident and have Bachelors in Information Technology and am currently working for a Finnish company and previously worked for companies in Dubai. I have a total of 12 years of experience in the software industry.

My current annual salary is approximately USD 78,000. However, during the past two years, my income was more than USD 80,000 per annum with my previous employers. If I calculate the average income over the last two years, it meets the required threshold i.e. 80,000 per annum

Given that I have had multiple employers during the last two years,* I would like to confirm if I am still eligible for the LTR Visa under these circumstances.*

If eligible, could you please advise on the specific documents I would need to provide to demonstrate my income history?

Would the following documents suffice?

Offer letters from my previous employers

Salary slips from my previous and current employers

Any other necessary documentation you might require

You might need a conversation with your employer, to see if they are au fait with respect to Permanent Establishment as defined in the Thailand-Finland tax treaty. PE is about the risk of your company being required to pay corporation tax in Thailand as a result of activities you do (I don't know what your job is, or might become). Note, corporation tax is levied on companies with PE conducting business with Thai industry. For companies with PE but no Thai business, they still have to file accounts, or risk a fine of 5% of global revenues....... A company might have to seek legal advice, and they would be entitled to pass those costs onto the employee, unless there is a business need for you to be in Thailand. Some companies are also pursuing clauses to pay a local rate of pay, so significantly less than you are making now, although the cost of living is lower.

The average past salary should do, if you can reasonably proof it (I.e. by notarized tax returns or the like). Your current employer needs to be a public company listed on stock exchange or a private company that is operating for at least 3 years, with a minimum combined revenue of USD 150 million for the last 3 years. You need to be a direct employee - not a freelancer. The LTR website is quite detailed as to criteria and required documents:

If i meet 80k salary criteria that is enough?

Or my current company also need to be private company operating for last 3 years with minimum revenue of USD 150 million?

Both conditions need to be satisfied or anyone is good?

You need both: an average salary of 80k USD AND your current employer needs to be publicly listed or big enough.
